When choosing a customs broker in Moscow, each time you have to deal with a huge number of offers of the most varied nature. There are more and more brokerage companies, and even now in the capital’s market there is a situation where not a single company, even from the list of the largest, manages to occupy more than 1% of the market.

This is due not only to the variety of offers, but also to the variety of wishes and needs of service customers. Some prefer to cooperate only with the largest and most famous performers who are capable of more or less quickly solving problems of any nature. Others specifically look for specialized brokers who deal exclusively with a few types of services, but are able to offer the most efficient and high-quality service in their narrow niche.

Also, many customers choose brokers based on external statistical indicators, on the basis of which various ratings are formed. Unlike most other regions of Russia, in Moscow there are many ratings for capital customs brokers. Another thing is that each of them is based on different data, and the indicators in it are sharpened taking into account the interests of one particular company, in fact, this rating is a component. Therefore, one can observe a situation in which there are a number of lists with completely different companies in it. If we try to create a universal rating that takes into account all the main parameters of activity, such as market share, the number and weight of declared goods and other indicators, the top ten customs brokers in Moscow will look like this:

Rating of customs brokers based on the results of 2021

In fact, little changes here. We have 381 brokers in import and 373 brokers in export. There are 385 brokers in total. The broker rarely receives a percentage of the amount. His task is to formalize. Earnings are recalculated from one declaration. Some are cheaper, some are more expensive. Export leaders have gigantic volumes. But the number of declarations is small.

In exports, 482.5 thousand declarations were issued for almost R3.1 trillion.

The level of concentration in exports is very high. The first broker prepares 6% of declarations. The top three are 16% and 67% of the declaration amount. In third place is Sintech, which processes half of the country’s oil. The top ten prepare 34.6% of declarations, or 88% of all exports.

In imports, the leader prepares 3% of declarations. The top three are 6.4% and 9% of the value, the top ten are 16.6% of declarations, 19% of the amount.

Customs representatives: quantity does not translate into quality

The Guild of Professional Participants in Foreign Economic Activity once again analyzed changes in the situation in the market for the provision of customs-related services in the Northwestern Federal District. If at the beginning of the year we noted a steady decline in the number of customs representatives included in the Register of the Federal Customs Service of Russia, now we can confidently state the actual restoration of the pre-crisis level, which is confirmed by the indicators shown in the graph.

Upon careful study of the structure of the Register in December 2010, it becomes obvious that the beginning of 2011 is actually associated with the “restoration of the list,” that is, in the first quarter, organizations were included in the Register that, for one reason or another, were not included in it in December. In my opinion, the “non-renewal of powers” ​​of a number of companies with the onset of January 1, 2011 was, first of all, due to the sluggishness of their own lawyers, or employees of the relevant departments of the Federal Customs Service of Russia.

The second factor influencing this process is the significant “overheating” of the market for banking services for the provision of bank guarantees. At the same time, there was a thirteen-fold excess in the volume of banking supply in the form of the total limit according to the Register of Banks of the Federal Customs Service of Russia (156 billion rubles) in relation to demand out of 300 (12 billion rubles) bank guarantees issued to customs representatives.

Continuing the banking theme, it should be noted that already at the beginning of last year it became obvious: the appetites of banks have become significantly more moderate. If in the post-crisis period, during the period when the Federal Customs Service of Russia abolished the validity of surety agreements, not many people were able to service a bank guarantee, but now a bank commission in the amount of 4-6% per annum (without collateral or deposit) is quite acceptable. Today, in terms of financial burden, it is slightly higher than the costs associated with the necessary security under the guarantee agreement.

So, there is a quantitative upward change in the Register of Customs Representatives. Unfortunately, we are still not talking about the quality component. The position of customs representatives still looks very unconvincing against the backdrop of the pressure on them to provide security in the amount of 1 million euros, which in ruble equivalent now fluctuates around 41.2 million rubles, as well as the obligation to bear joint liability for the payment of customs duties and the very real possibility part with the business due to debt to customs authorities in an amount slightly exceeding 250 thousand rubles. Such a discrepancy between the amount of security, the complexity of entering a business in comparison with the opportunity to say goodbye to everything overnight causes bewilderment and a natural desire to find a fair solution to this contradiction.

Opportunity to speak out The exclusion of business from participation in the formation of customs policy in the country has long haunted progressive economists and leaders of business associations. All over the world, business communities are actively lobbying through special procedures for laws that would equalize the excessive regulatory impact on them from state regulatory authorities. Finally, the Russian Government has taken the first step towards the development of Article 53 of the Law “On Customs Regulation in the Russian Federation”: four all-Russian associations (CCI of the Russian Federation, NP OPORA RUSSIA, Business Russia and the Russian Union of Industrialists and Entrepreneurs) have been granted the right to public examination of regulatory acts of the Federal Customs Service of Russia . At the same time, Decree of the President of the Russian Federation dated July 12, 2011 No. 929 “On amending the Regulations on the Ministry of Justice of the Russian Federation, approved by Decree of the President of the Russian Federation dated October 13, 2004 No. 1313,” unfortunately, went virtually unnoticed. This document amends paragraph 15: “send, in the manner established by the Government of the Russian Federation, on the basis of a proposal from the Ministry of Economic Development of the Russian Federation to the federal executive authorities, a proposal to cancel or amend the regulatory legal acts adopted by them or their individual provisions that unreasonably complicate the conduct of business and investment activity". That is, now the Ministry of Economic Development has the right to cancel or make the necessary changes to any regulations. To do this, it is important for professional businesses to correctly justify that the actions of certain departments make it difficult to conduct business. Thus, the business community has the opportunity to influence the regulations issued by the Federal Customs Service of Russia and other regulatory bodies that contain rules that hinder the development of entrepreneurship, with signs of redundant control, as well as corruption-intensive ones.

Desire to steer

Recently, the mood of business circles providing services in the field of customs has been steadily increasing to take the path of self-regulation. According to our information, a number of initiative groups are working to prepare bills aimed at establishing self-regulation in the field of customs and foreign trade activities. Our guild has long been actively involved in the process of creating its own version of a professional law on self-regulation of the activities of customs representatives. In my opinion, the introduction of self-regulation in this area of ​​activity will actually relieve the state, represented by the customs service, from excessive control over the functioning of the professional environment. As a positive example, we can cite the experience of self-regulation in the construction sector and in a number of other industries.

Expanding opportunities In June of this year, a long-awaited event took place for members of the regional association of customs brokers “North-West”: the Ministry of Justice re-registered our organization into the non-profit partnership “Guild of Professional Participants in the Market for Providing Services in the Field of Customs and Foreign Economic Activity” (NP “GPU VED” ). Today, the geography of the Guild’s presence in the regions is successfully expanding; it has representative offices in the Far East, the south of the country and Moscow. In the North-West, the share of goods declarations (GD) prepared by guild members is looking more and more convincing. Thus, of the TOP-20 largest customs representatives in the region, 13 are members of the guild. If we talk about the traditional analysis of leaders by the number of issued declarations, we should note the appearance of new names in the ranking of the top 5. If we compare with the monitoring results at the end of the year, we can note the following fact: St. Petersburg Customs Consultant LLC broke into the top five, and immediately took the role of leader.

At the same time, Voskhod LLC and North-West Telecom LLC changed places once again. Rostek North-West dropped from 4th place to 7th, and the incomprehensible Stolichnaya Logistics Company also dropped out of the top twenty.
