REGULATIONS ON THE PROCEDURE FOR CERTIFICATION OF EMPLOYEES OF THE CUSTOMS AUTHORITIES OF THE RUSSIAN FEDERATION

I. General provisions

1. Certification of employees of the customs authorities of the Russian Federation is carried out in the customs authorities of the Russian Federation and institutions under the jurisdiction of the Federal Customs Service of Russia (hereinafter referred to as the customs authorities) to resolve issues:

1) on the suitability of a customs authority employee for the position held;

2) on the nomination of a customs authority employee for a state award of the Russian Federation.

2. Certification to resolve the issue of suitability of a customs authority employee (hereinafter referred to as the employee) for the position held may be regular or early.

3. The next certification of employees is carried out no more than once every two years, but at least once every four years.

4. Early certification of an employee can be carried out on the basis of an order of the customs authority in agreement with the head of a higher customs authority, except for the cases specified in paragraph 6 of this Regulation on the procedure for conducting certification of employees of customs authorities of the Russian Federation (hereinafter referred to as the Regulation), no earlier than 30 calendar days after the relevant order is submitted to the employee for signature.

5. Certification to resolve issues of nominating employees for a state award of the Russian Federation is carried out taking into account the specifics provided for in Chapter IV of these Regulations.

6. Employees are not subject to certification:

1) holding positions for less than a year;

2) at the disposal of the head of the customs authority in connection with the implementation of organizational and staffing measures;

3) seconded to government bodies of the Russian Federation and organizations (these categories of employees are not subject to certification for the period of assignment);

4) employees on maternity leave, child care leave, and pregnant women (certification of these employees is carried out no earlier than a year after leaving leave).

7. The following certification commissions are created in the system of customs authorities:

1) Higher Certification Commission of the Federal Customs Service of Russia;

2) certification commission of the Federal Customs Service of Russia for certification of law enforcement officers;

3) certification commission of the central office of the Federal Customs Service of Russia;

4) certification commissions of regional customs departments;

5) certification commissions of regional customs departments for certification of law enforcement officers;

6) customs certification commissions;

7) certification commission of the Russian Customs Academy.

By decision of the head of the Federal Customs Service of Russia, other certification commissions may be created.

8. Certification commissions are created by orders of the relevant customs authorities in the following composition: the chairman of the certification commission, his deputy (deputies), members of the certification commission and the secretary (secretaries).

The certification commissions may include: deputy head of the customs authority, head of the personnel department, head of the anti-corruption unit, head of the legal department, psychologist and other officials by decision of the head of the customs authority.

9. The certification commission carries out its activities in accordance with the regulations of the certification commission (hereinafter referred to as the Regulations), developed taking into account these Regulations and approved by order of the relevant customs authority.

10. The positions of employees subject to certification by the relevant certification commissions, as well as officials responsible for preparing reviews of certified employees and approving the certification results, are determined by the standard certification scheme for customs officers, which is approved by order of the Federal Customs Service of Russia (hereinafter referred to as the Standard Certification Scheme).

II. Preparation for certification

11. Semi-annual work plans of the certification commission of the customs authority, semi-annual certification schedules and lists of employees subject to certification are drawn up by the personnel department and approved by the head of the relevant customs authority.

The certification schedule indicates: the name of the customs authority, initials, surname, special rank of the employee, the name of the structural unit, position held, the date of certification, the date of submission of the necessary documents to the certification commission indicating the responsible heads of the relevant divisions of the customs authority.

When creating a certification schedule, the date of appointment to the employee’s position and the date of the last certification are taken into account.

Certification schedules for the first and second half of the year are approved no later than December 25 and June 25, respectively.

No later than 30 calendar days before the date of certification, employees subject to certification must be familiarized with the certification schedule.

If it is impossible for an employee to be present on the day of certification at work for good reasons based on the information provided that was not known at the time of drawing up the schedule (vacation, illness, business trip, etc.), appropriate changes are made to the certification schedule.

12. No later than 14 calendar days before the date of certification, the secretary of the relevant certification commission is provided with a review of the employee’s performance (hereinafter referred to as the review) (Appendix No. 1 to the Regulations), prepared by the head of the employee being certified.

13. When preparing a review, the supervisor of the employee being certified must:

1) study the current procedure for employee certification;

2) conduct an individual conversation with the certified person on issues of serving in the customs authorities of the Russian Federation, improving professional qualities, give the necessary recommendations for eliminating shortcomings, increasing personal responsibility for the state of affairs in the assigned area of ​​​​work;

3) give an objective assessment of the business and personal qualities of the certified employee, his professional level, organizational abilities, the state of service discipline and determine the content of the characteristics.

14. In the text of the characteristics of the certified employee, it is recommended to reflect the following questions, depending on the position held:

a) the employee’s compliance with the requirements for the position;

b) the level of professional training, knowledge of the Constitution of the Russian Federation, the requirements of legislative and other regulations governing the practical activities of the employee, as well as knowledge of the job description and its implementation during the service;

c) organization in work, the ability to determine the main thing in solving assigned tasks, the ability to perform job duties efficiently, take initiative, quickly navigate and skillfully act in a difficult environment;

d) achieved results of official activities, personal contribution of the employee to the implementation of assigned tasks;

e) ability to manage subordinates;

f) assessment of the condition of the structural unit, customs authority, which is headed by the employee;

g) the ability to critically evaluate one’s own activities and the activities of subordinates; existing shortcomings and omissions in official activities, in the management of the unit, customs authority and recommendations for their elimination;

h) fulfillment of the requirements of the employee’s oath, duties set out in the Federal Law “On Service in the Customs Authorities of the Russian Federation”, the Disciplinary Charter of the Customs Service of the Russian Federation.

15. The secretary of the certification commission, no less than seven calendar days before the start of certification, is obliged to familiarize the certified employee with the submitted review against signature.

16. The employee has the right to express his disagreement with the submitted review, as well as provide additional information about his performance for the previous period to the certification commission.

17. The secretary of the certification commission is obliged, within the time limits established by the Regulations, to report to the chairman of the certification commission on the number of documents received that are subject to consideration at the meeting, to notify the members of the certification commission and persons whose presence is necessary at the meeting of the certification commission about the time and place of the meeting, about the issues submitted for its consideration, as well as submit documents to be considered at the meeting to members of the certification commission.

18. If it is impossible for individual members of the certification commission or employees subject to certification or invited to the meeting to attend the meeting, these persons are required to submit an application in advance addressed to the chairman of the certification commission indicating the reasons for the impossibility of attending the meeting.

III. Carrying out certification

19. A meeting of the certification commission is considered valid if at least two-thirds of its members are present.

20. For the period of certification of an employee who is a member of the certification commission, his membership in the commission is suspended.

21. Certification is carried out in the presence of the employee being certified and his immediate superior (or his replacement).

If the certified employee fails to appear at a meeting of the certification commission for a valid reason, the certification will be postponed to a later date.

If a certified employee fails to appear at a meeting of the certification commission without a good reason, the employee may be subject to disciplinary action in the prescribed manner, and his certification will be postponed to a later date.

In order to carry out the certification objectively, the certification commission, if the certified employee provides additional information about his work activities for the period preceding the certification, and his statement of disagreement with the submitted review, has the right to postpone the certification of the employee to a later date.

22. An employee’s performance is assessed on the basis of determining compliance with the requirements of the job description, participation in solving assigned tasks, efficiency and effectiveness of the work performed, the availability of incentives and outstanding disciplinary sanctions.

23. The certification commission reviews the submitted documents, hears a report from the employee being certified about his official activities, and, if necessary, from his immediate superior.

Members of the certification commission have the right to ask the employee being certified questions related to the performance of job duties.

24. The secretary of the certification commission keeps minutes of the meeting of the certification commission (Appendix No. 2 to the Regulations), draws up an attestation sheet for an employee of the customs authority of the Russian Federation (Appendix No. 3 to the Regulations).

25. Based on the results of the certification, the certification commission makes one of the following decisions:

1) corresponds to the position held;

2) does not correspond to the position held.

26. The decision of the certification commission is made by open voting in the absence of the employee being certified and his immediate superior by a simple majority of votes of the members of the certification commission present at the meeting.

The chairman of the certification commission, the deputy chairman of the certification commission, and members of the certification commission have equal rights when voting. The secretary of the certification commission does not participate in voting.

In case of equality of votes, the certified employee is recognized as corresponding to the position held.

27. Based on the results of the certification, the certification commission has the right to submit for consideration the head of the customs authority motivated recommendations on promoting an employee to a position, on including an employee in the reserve for promotion to a higher position, on applying a disciplinary sanction in the form of a warning about incomplete official compliance based on the results of certification, on demotion employee in position, about the dismissal of the employee.

28. The results of the certification are recorded in the minutes of the meeting of the certification commission and the employee’s certification sheet. The minutes of the meeting of the certification commission are signed by the chairman, deputy chairman, secretary and members of the certification commission present at the meeting.

The certification results are communicated to the certified employee immediately after the voting results are summed up.

29. The employee’s certification sheet with the results of the certification, signed by the chairman and secretary of the certification commission, is submitted to the head of the relevant customs authority no later than seven working days after it was carried out.

30. The head of the customs authority is obliged to make a decision on approval (non-approval) of the certification results no later than ten working days from the date of submission of the certification sheet for approval.

31. The secretary of the certification commission is obliged to familiarize the employee with the approved (unapproved) certification sheet no later than ten working days from the date of its approval (non-approval) against signature (this period is extended while the employee is on a business trip, vacation, illness, etc.).

32. Based on the results of certification, the head of the customs authority may decide:

1) on leaving an employee in his position;

2) on the inclusion of an employee in the reserve for promotion to a higher position;

3) on the transfer of an employee to another vacant position;

4) on the imposition of a disciplinary sanction on an employee in the form of a warning about incomplete official compliance based on the results of certification;

5) on the dismissal of an employee from service in the customs authorities.

These decisions, in addition to the decision to impose a disciplinary sanction on an employee in the form of a warning about incomplete official compliance based on the results of certification, are made by the head of the relevant customs authority no later than two months from the date of certification.

The decision to impose a disciplinary sanction on an employee in the form of a warning about incomplete official compliance based on the results of certification and the issuance of the corresponding order by the head of the customs authority is carried out no later than a month from the date of the decision by the certification commission.

The time period established for making a decision by the head of the customs authority based on the results of certification does not include the period of the employee being on vacation and the time of illness.

IV. Features of certification to resolve issues regarding the nomination of employees for the state award of the Russian Federation

33. When conducting certification to resolve issues regarding the nomination of an employee for a state award of the Russian Federation, a review of the employee’s performance and an attestation sheet are not drawn up.

The head of the customs authority (structural unit) in which the certified employee is serving prepares an award sheet in the form established by the legislation of the Russian Federation and submits it to the secretary of the certification commission in accordance with the Standard Certification Scheme.

34. The characteristics of the employee contained in the award sheet must reflect his specific merits and the type of award for which he is nominated.

35. Based on the results of the certification, the certification commission makes one of the following decisions:

1) is nominated for a state award of the Russian Federation;

2) is not submitted for a state award of the Russian Federation.

36. When the certification commission makes a decision to nominate an employee for a state award of the Russian Federation, the award sheet is drawn up by the secretary of the certification commission, signed by the head of the customs authority and, in the prescribed manner, sent to a higher customs authority.

V. Final provisions

37. If an employee disagrees with the decision of the head of the customs authority made based on the results of certification, he has the right to appeal this decision in the manner prescribed by the legislation of the Russian Federation.

38. Minutes of meetings of certification commissions are stored in the personnel department of the customs authority. Reviews and performance certificates of employees are stored in their personal files.

39. Control over the organization of work and activities of the certification commission is exercised by the head of the customs authority.

40. Methodological management of the activities of certification commissions is carried out by the Department of Civil Service and Personnel of the Federal Customs Service of Russia.

VIRTUAL CUSTOMS CUSTOMS AND LOGISTICS PORTAL

Pursuant to Article 47 of the Federal Law of July 21, 1997 N 114-FZ “On Service in the Customs Authorities of the Russian Federation” (Collection of Legislation of the Russian Federation, 1997, N 30, Art. 3586; 2000, N 33, Art. 3348; N 46, Art. 4537; 2002, N 27, Art. 2620; N 30, Art. 3029, Art. 3033; 2003, N 1, Art. 15), for the purpose of staffing the customs authorities of the Russian Federation and organizations of the State Customs Committee of Russia (hereinafter - customs authorities ) highly professional personnel, ensuring an objective assessment of the performance of employees of the customs authorities of the Russian Federation (hereinafter - employees), as well as for further improvement of the selection and placement of personnel, I order: 1. Approve the Regulations on the procedure for conducting certification of employees of the customs authorities of the Russian Federation (hereinafter - Regulations) (Appendix 1). 2. When conducting certification of customs officers, the certification commissions of the customs authorities of the Russian Federation shall be guided by the Regulations approved by this Order. 3. The heads of customs authorities should bring this Order to the attention of subordinate officials and take organizational measures for its implementation. 4. First Deputy Chairman of the State Customs Committee of Russia V.V. Makarov to monitor the implementation of this Order.

Appendix 1 to Order of the State Customs Committee of Russia dated October 29, 2003 N 1215

REGULATIONS ON THE PROCEDURE FOR CERTIFICATION OF EMPLOYEES OF THE CUSTOMS AUTHORITIES OF THE RUSSIAN FEDERATION

This Regulation on the procedure for certification of employees of the customs authorities of the Russian Federation (hereinafter referred to as the Regulation) was developed in accordance with Articles 47 and 56 of the Federal Law of July 21, 1997 N 114-FZ “On Service in the Customs Authorities of the Russian Federation” (Collection of Legislation of the Russian Federation, 1997 , N 30, Art. 3586; 2000, N 33, Art. 3348; N 46, Art. 4537; 2002, N 27, Art. 2620; N 30, Art. 3029, Art. 3033; 2003, N 1, Art. 15, No. 27 (Part I), Article 2700) and regulates the activities of certification commissions of the customs authorities of the Russian Federation and organizations of the State Customs Committee of Russia (hereinafter referred to as the certification commission). This Regulation determines the procedure for certification of employees of the customs authorities of the Russian Federation (hereinafter referred to as employees).

I. General provisions

1. The purpose of certification is to determine the level of professional training, an objective assessment of the employee’s official and professional activities, and determine his suitability for the position held. 2. Certification should contribute to improving the activities of the customs authority in the selection, advanced training and placement of employees of the customs authorities of the Russian Federation. 3. The next certification of employees of the customs authorities of the Russian Federation when considering the issue of suitability for the position held is carried out no more than once every two years, but not less than once every four years. Early certification of an employee can be carried out on the basis of an order from the head of the customs authority in agreement with the head of a higher customs authority, except for the cases specified in clause 4 of these Regulations. 4. Employees who are not subject to certification are: 1) holding positions for less than a year; 2) at the disposal of the head of the customs authority in connection with the implementation of organizational and staffing measures; 3) seconded to government bodies of the Russian Federation and organizations (these categories of employees are not subject to certification for the period of assignment); 4) employees on maternity leave, child care leave and pregnant women (certification of these employees is carried out no earlier than one year after leaving leave).

II. Procedure for certification

5. Attestation sheets for employees are compiled by their immediate superiors in accordance with the assignment nomenclature and the Standard Certification Scheme. 6. Managers who draw up employee certification sheets are required to: 1) study the current procedure for employee certification; 2) conduct an individual conversation with the certified person on issues of serving in the customs authorities of the Russian Federation, improving professional qualities, give the necessary recommendations for eliminating shortcomings, increasing personal responsibility for the state of affairs in the assigned area of ​​​​work; 3) give an objective assessment of the business and personal qualities of the certified employee, his professional level, organizational abilities, the state of service discipline and determine the content of the characteristics and conclusions on it. 7. The procedure for preparing an employee’s certification sheet (Appendix 1 to the Regulations): 1) the head of a structural unit (customs authority), no later than two weeks before the start of certification, submits to the personnel department (department) (secretary of the certification commission) an certification sheet for a subordinate employee ; 2) the personnel department of the customs authority, no less than a week before the start of certification, must familiarize each employee with the submitted characteristics for him against signature. In the text of the characteristics of the person being certified, stated in free form, it is recommended to reflect the following questions, depending on the position held: a) the employee’s compliance with the requirements for the position held; b) the level of professional training, knowledge of the Constitution of the Russian Federation, the requirements of legislative and other regulations governing the practical activities of the employee, as well as knowledge of the job description and its implementation during the service; c) organization in work, the ability to determine the main thing in solving assigned tasks, the ability to perform job duties efficiently, take initiative, quickly navigate and skillfully act in a difficult environment; d) achieved results of official activities, personal contribution of the employee to the implementation of assigned tasks; e) the ability to manage subordinates, train and educate them; f) assessment of the state of the structural unit, customs authority, which is headed by the person being certified; g) the ability to critically evaluate one’s own activities and the activities of subordinates; existing shortcomings and omissions in official activities, in the management of the unit, customs authority and recommendations for their elimination; h) fulfillment of the requirements of the employee’s oath, duties set out in the Federal Law “On Service in the Customs Authorities of the Russian Federation”, the Disciplinary Charter of the Customs Service (approved by Decree of the President of the Russian Federation of November 16, 1998 N 1396, published in Rossiyskaya Gazeta N 224, 25.11. 1998). In conclusion, the characteristics indicate whether the person being certified corresponds or does not correspond to the position held, as well as recommendations on issues of further service. At each subsequent certification, the employee’s certification sheet with the date and conclusions of the previous certification is submitted to the certification commission. In cases where early certification was carried out, the corresponding certification sheet is presented. 8. Employees have the right to provide the certification commission with additional information about their performance for the previous period, as well as express their disagreement with the characteristics presented. 9. Certification commissions are formed in the State Customs Committee of Russia - in the main departments, departments, independent services, departments (by decision of the chairman of the State Customs Committee of Russia), in customs authorities by order of the relevant customs authority in the following composition: the chairman of the certification commission, his deputy (deputies), members of the certification committee commission and secretary (executive secretary of the Higher Attestation Commission (HAC) of the State Customs Committee of Russia). The secretary of the certification commission has the right of an advisory vote. The certification commission may include: first deputy head of the customs authority, deputy head of the customs authority for personnel, deputy head of the customs authority for personal security, head of the legal unit, head of the personnel department (department), psychologist and other officials by decision of the head of the customs authority . The Higher Certification Commission is formed to carry out certification of the management staff of customs authorities, and also acts as an appellate authority. 10. The annual work plan of the certification commission, the annual certification schedule and lists of employees of the customs authorities of the Russian Federation subject to certification are drawn up by the chairman of the certification commission together with the personnel department (department) and approved by the head of the relevant customs authority. In the main departments, directorates, independent services, departments of the State Customs Committee of Russia, annual plans, schedules, as well as lists of employees subject to certification, are drawn up jointly with the personnel department of the central apparatus of the Main Personnel Directorate of the State Customs Committee of Russia and approved by the first deputy, deputy chairman of the State Customs Committee of Russia, supervising the main department , management, independent service, department. The schedule indicates: the name of the customs authority, initials, surname, special rank of the employee, the name of the unit in which the person being certified serves, the position held, the date of certification, the date of submission of the necessary documents to the certification commission, indicating the responsible managers of the relevant units of the customs authority. The date of certification is brought to the attention of the employee being certified at least one month before it takes place. Early certification is carried out no earlier than a month from the moment the relevant order is communicated to the employee being certified. A meeting of the certification commission is held at least once a month (in accordance with the certification schedule), and also as necessary.

III. Carrying out certification

11. The meeting of the certification commission is held in accordance with the regulations of the certification commission of the customs authority (Appendix 2 to the Regulations). Certification is carried out in the presence of the employee being certified. If the employee being certified fails to appear at a meeting of the certification commission without good reason, the commission may conduct certification in his absence. The certification commission reviews the submitted documents, hears a report from the certified employee and, if necessary, his immediate superior about the professional activities of the certified employee. The certification commission, for the purpose of objective certification, after the certified person provides additional information about his work activities for the period preceding the certification, and his statement of disagreement with the presented characteristics, has the right to postpone the certification of the employee to the next meeting of the commission. 12. Based on the results of the certification, the certification commission gives the employee one of the following ratings: 1) corresponds to the position held; 2) corresponds to the position held, subject to the implementation of the recommendations of the certification commission on his official activities; 3) does not correspond to the position held. Based on the results of the certification, the certification commission has the right to submit to the head of the customs authority motivated recommendations on promoting an employee to a position, on including an employee in the reserve for promotion to a higher position, on demotion or appointment to another position. 13. The conclusions of the certification commission are entered into the minutes of the meeting and recorded in the employee’s certification sheet (Appendix 1 to the Regulations), which is signed by the chairman and secretary of the certification commission. The conclusion of the certification commission is announced to the person being certified by the chairman of the commission immediately after voting. The approved certification sheet is kept in the employee’s personal file. 14. The results of the certification of a customs officer are presented to the head of the relevant customs authority no later than seven days after it was carried out. 15. The head of the customs authority is obliged to make a decision on approval (non-approval) of the certification result no later than 10 days from the date of submission of the certification sheet for approval. The results of the certification are announced to the employee by the immediate superior within 7 days from the date of approval of the certification against signature (this period is extended while the employee is on a business trip, sick leave, etc.). 16. The head of the customs authority, based on the results of the certification, makes a decision: 1) on the promotion of an employee; 2) on the inclusion of an employee in the reserve for promotion to a higher position; 3) about leaving the employee in his previous position; 4) about leaving the employee in his previous position with a warning about incomplete professional compliance; 5) about demotion or appointment to another position; 6) about dismissal. The head of the relevant customs authority makes these decisions no later than two months from the date of approval of the certification. After the expiration of the specified period, transfer of the employee to another or lower position, or dismissal of the employee based on the results of this certification is not allowed. An employee's time of illness and vacation is not counted in the 2-month period. 17. If an employee disagrees with the decision of the head of the customs authority, made based on the results of certification, he has the right to appeal this decision to the head of a higher customs authority or in court. If the complaint is recognized as justified, appropriate changes are made to the certification or a new certification sheet is drawn up. The changed (or new) certification sheet is subject to consideration by the certification commission in accordance with the established procedure. 18. Consideration of the issue of nominating an employee for a state award of the Russian Federation is carried out in the manner prescribed by these Regulations. The characteristics of an employee nominated for a state award of the Russian Federation must reflect his specific merits and the type of award for which he is nominated. The decision of the certification commission indicates whether or not the employee is worthy of being nominated for a state award of the Russian Federation. 19. Control over the organization of work and activities of the certification commission is exercised by the head of the relevant customs authority and the personnel departments of higher customs authorities. 20. General and methodological guidance, as well as control over the activities of certification commissions, is carried out by the Main Personnel Directorate of the State Customs Committee of Russia.

CERTIFICATING SHEET OF AN EMPLOYEE OF THE CUSTOMS AUTHORITY OF THE RUSSIAN FEDERATION

Appendix 2 to the Regulations on the procedure for certification of customs officers of the Russian Federation

WORK REGULATIONS OF THE CERTIFICATION COMMISSION OF THE CUSTOMS AUTHORITY OF THE RUSSIAN FEDERATION

I. Preparation of the meeting of the certification commission and the list of documents submitted for consideration

1. The head of a structural unit (customs authority) for employees subject to certification submits to the personnel department (department) of the customs authority no later than two weeks before the meeting of the certification commission: 1) certification sheets and a list of employees indicating the last name, first name, patronymic, position held, date and number of the appointment order - when considering the issue of suitability for the position held (at each subsequent certification of an employee, his certification sheet with the data of the previous certification is also presented); 2) a draft award sheet for an employee - when considering the issue of nomination for a state award of the Russian Federation. 2. The secretary of the certification commission, a week before the next meeting, reports to its chairman on the number of received documents submitted for consideration by the certification commission, and proposals to invite relevant officials to its meeting. 3. The secretary of the certification commission notifies in advance the members of the certification commission and persons whose presence is necessary about the time and place of the meeting, as well as the issues submitted for its consideration. 4. If it is impossible for individual members of the certification commission or employees to be certified or invited to attend a meeting, these persons are required to inform the secretary of the certification commission in advance.

II. Conducting a meeting of the certification commission and the procedure for making decisions

5. A meeting of the certification commission is considered valid if at least 2/3 of its members are present. The meeting of the certification commission is chaired by its chairman or, on his instructions, by the deputy chairman of the certification commission. 6. Certification is carried out in the presence of the employee being certified and the head of the structural unit (customs authority) in which the certified person holds a position, or a person replacing him. If an employee fails to appear at a meeting of the certification commission without a good reason, the certification commission may conduct certification in his absence, about which a corresponding entry is made in the minutes. In this case, the personnel department (department) provides a certificate of the reason for the employee’s absence for inclusion in the minutes of the meeting of the certification commission. 7. Certification of employees who are members of the certification commission is carried out on a general basis. An employee undergoing certification, who is a member of the certification commission, does not participate in voting. 8. During a meeting of the certification commission, the secretary of the commission keeps a free-form protocol, which reflects the progress of the meeting of the certification commission, the voting results, indicating the number of votes “for” or “against” the adoption of this decision and the decision made. A copy of the draft certification sheet is attached to the protocol, and sheets with the dissenting opinion of the members of the certification commission may be attached. The protocols of the certification commission are stored in the personnel department of the customs authority. 9. Decisions of the certification commission on the issues under consideration are made by open voting by a simple majority of votes.

In case of equality of votes, the employee is recognized as corresponding to the position held.
