Legislative justification for declaring a vehicle

Filling out a permit document is required in order to confirm the legality of transporting the vehicle, as well as to determine the customs value for payment of customs duties and other payments.

According to the Customs Code, when exporting or importing a vehicle through customs points on the territory of the Customs Union (EAEU), it is necessary to fill out and submit a declaration for the vehicle, on the basis of which it will be released by customs representatives further. It contains information:

  • about the cargo being transported;
  • about the route;
  • about the purposes for which the border is crossed;
  • about equipment and spare parts that are in transport.

After checking the customs declaration for the vehicle and checking the information specified in it with the actual data, a customs specialist will issue a permit for international transportation.

What papers are submitted along with the GDT form?

Regulatory acts provide for a list of documents submitted simultaneously with the declaration to the relevant customs authority. Below is a complete list.

A certificate that officially confirms the ability to submit a declaration of intent on one’s own behalf.

  • Transport papers indicating that the cargo crossed the state border of the Russian Federation.
  • A copy of the passport of the foreign economic agreement.
  • Certificate of customs value.
  • Product delivery control certificate.
  • Receipts for payment of duties.
  • Photo of the customs declaration (electronic copy on a medium).

When and who must fill out a customs declaration for transport?

Vehicles transported across the border of the EAEU are subject to customs declaration:

  • when cargo is imported or entered into the territory of the Customs Union (EAEU), namely temporarily imported vehicles, with their further removal from the territory;
  • when they are exported or leave the customs territory of a vehicle with its further import.

The TD is filled out by the declarant, whose role may be the carrier himself or another person who is his official representative; this right is also enshrined in Art. 278 Labor Code of the Customs Union (EAEU) in clause 2.

If the carrier's standard documents for international transportation contain all the information that must be indicated in the declaration for the vehicle, then they can replace the TD.

The execution of a customs declaration for a vehicle is similar in principle to the execution of a customs declaration for other products and, in general, is regulated by a decision of the Eurasian Economic Commission.

A customs declaration for a vehicle in 2021 can be submitted electronically or on paper; in the latter case, documents that confirm the information stated in it are also attached to the TD. If the TD is submitted electronically, supporting documents do not need to be attached to it.

Requirements for registration of TD on a vehicle

The form and form of the customs declaration for a car is regulated in the Decision of the Board of the Eurasian Economic Commission; it is an A4 document consisting of one sheet, in which there are several columns for indicating information about the transport itself, the purpose of transportation and other points, its forms differ depending on the purpose customs declaration. The TD is filled out in two copies: one remains with the customs office, the second version – with the applicant (declarant). Although the document exists in two copies, each party fills out not a separate copy, but its own part of the form.

The basic requirements for filling out the document are defined in Instruction No. 422 and Art. 180 and 350 TK TS, they relate to the paper version of the TD:

  • all information must be written in Cyrillic, in capital letters, possibly written by hand or using a printing device;
  • corrections and blots are not omitted, except for those provided for in the instructions;
  • the use of the Latin alphabet is acceptable when writing the addresses of foreign persons and the number of the vehicle itself;
  • a declaration is issued for each unit of transport;
  • changes and additions are made by the declarant or his representative, each change must be certified by the signature and seal of an official (customs officer).

If there is not enough space on the first sheet to enter all the required information, then the information is transferred to the reverse side or additional sheets, about which a corresponding mark is placed on the main sheet. All information that will be indicated or on an additional sheet. Or on the back, it must be certified by the signature of the declarant himself and an authorized person (representative of the customs point), the latter also puts his stamp. The customs declaration for the vehicle can be downloaded in advance and filled out in Excel or later, at the customs point, by hand.

Algorithm

The first part of the article was devoted to what it is - GDT, interaction with customs, and a decoding of the abbreviation was also given. Now you need to find out exactly how the registration process occurs.

First of all, it is necessary to indicate that the declaration is filled out in the form established by the CU Commission. It is a brochure or just several A4 forms. The filling rules are regulated by a special body - the State Customs Committee. The necessary instructions are contained in the order “On approval of the Instructions on the procedure for filling out the customs declaration.”

First of all, work is carried out on the main sheet - TD 1. It is concluded for cargo with a single name and mode of movement. 4 copies are made. The first one is sent to the archive for storage. The second goes to the statistics department. The third is given to the applicant for reporting activities. The latter is attached to the goods and sent to the checkpoint. It carries out customs clearance.

Basic information must be provided by the declarant. Many people feel uncomfortable with the abundance of data and information. Especially beginners who did not know before that this is a gas turbine engine mode and what documents are needed. But if you figure it out, the procedure won’t be so complicated. When accepting papers, a special stamp is placed. The completed stages of control are noted in special columns.

In addition, there is a sheet of form TD 2. If goods are transported together, which include products with different names, then it must be filled out. One additional form can contain up to 3 articles. The maximum number of such pages is not specified in the legislation. The filling out procedure is similar to the previous form.

Features of filling out declarations for a car

When filling out a customs declaration for a car on their own, declarants (the carriers themselves or the owners of the cargo) can often make mistakes and write unnecessary information. The most common mistakes are filling out the wrong part of the form or entering incorrect information, for example, the wrong date. Errors are automatically corrected, corrections are not certified, as a result of which filling out the TD is considered incorrect, and customs simply will not accept such a declaration, after which you will have to fill out a new form.

In addition, there are several forms for filling out the declaration based on their purpose, and you need to be well aware of all the nuances of their execution and the established requirements. Foreign economic activity participants, starting from January 1, 2021, have the right to fill out declarations and provide permits in electronic format; for this purpose, a system of interdepartmental interaction is used through the personal account of the foreign economic activity participant. In this case, customs specialists receive all permits from the system without requesting them from the declarant; the previously provided documents are stored in their personal account; the declarant has the opportunity to review them and add to the list.

To fill out a customs declaration for a vehicle, a foreign trade participant can choose two options:

  • on one's own;
  • through a customs representative.

The document itself consists of a form with columns in which the text is entered, and fields where you need to tick the corresponding information. Both the carrier himself and his representative (declarant) fill out the upper part of the document, in particular, the following information is indicated:

  • data about the vehicle, namely the make, model of the car, type according to the vehicle classifier, number and VIN number, country where the vehicle is registered;
  • name of the carrier, full name of its representative;
  • route, country and final destination;
  • purpose of import or export.

Next is the signature and date of completion. Customs officials put marks at the bottom of the form, each column of the document is filled out at different times, in accordance with the stages of transportation.

The difference between the new passenger declaration and the old one

The main difference between the old form of 2021 and earlier years from 2020 is the number of columns (items and subitems) required to fill out. In the old one: paragraph 3 includes five subparagraphs (3.1 - 3.5); in the new 3 paragraph consists of ten subparagraphs (3.1-3.10), and also in the new one an expanded 5 paragraph has been added, which was previously 3.3.

Submission deadlines and responsibility for lack of TD

The customs declaration for the vehicle is submitted for consideration to a customs representative; the deadline for its submission varies, depending on whether import or export is carried out. A mandatory condition for submitting a TD is to provide an export declaration in advance, before the very moment of export. The period for consideration of the declaration by a customs officer is no more than 2 hours.

If you do not declare a vehicle, the individual or organization that owns it may be subject to a fine ranging from half to two times the value of the vehicle. In addition, in some cases, the car may also be confiscated. If the declaration was made late and the regulatory authority did not have time to notify the carrier of prosecution, a fine can be avoided.

It is important not to make mistakes when filling out the declaration, and it is quite difficult to do this without the relevant experience, which is why many companies today prefer to use the services of professional specialists.

If the document itself exists, but it contains false information, the declarant is also liable, but only if these data led to an underestimation of the amount of duties or an exemption from their payment, in this case a fine of 0.5 to 2 times the amount of the lost amount of duties is imposed .

How is the document number generated?

It makes sense to concentrate on this more carefully. After the declarant has filled out the forms, the papers are thoroughly checked and registered. They are then assigned an individual number. However, it does not consist of random numbers, but is formed according to clear rules.

The first block is 8 characters. This is the code of the customs organization where clearance is carried out. The second is the registration date. The number comes first, followed by the month and the last two digits of the current year. For example, April 18, 2021 will look like this: 180420.

The third part includes 7 numbers. This is a serial number assigned to the declaration by the relevant authority. The countdown starts from the beginning of the calendar year. For example, No. 0000002 is the second in a row. Elements are separated by a “/” sign; spaces or other characters cannot be inserted.
