Customs clearance of exports is mandatory for the official movement of goods and cargo across the customs border of the Russian Federation. In our realities, this procedure is one of the most difficult and requires considerable experience from the organization that carries it out. In the matter of customs clearance of international transport, you may encounter many unfamiliar words and legal terms. Here are the main ones:
- customs representative (broker)
– a legal entity that processes documents and represents the interests of the client in the competent authorities. The representative carries out his activities within the framework of a brokerage agreement; - customs clearance of goods and cargo
is a slang expression that is nevertheless often found among professionals. Means customs clearance with mandatory payment of prescribed payments upon import of goods; - declarant
- a specialist (individual or legal entity) who is authorized by customs authorities to declare goods and cargo when moving them across the state border; - customs clearance
is a slang expression meaning obtaining all necessary permits for exporting goods abroad. Includes obtaining a conclusion (permission) from FSTEC in cases where this is provided for by law, for example, when exporting dual-use equipment, oil, gas, round timber, etc.

Procedure
Customs clearance of international cargo is carried out in the following sequence:
The procedure for customs clearance of goods is strictly regulated by legal acts. It makes no sense to describe the entire procedure in detail; we will only talk about its key stages:
- Registration
of goods and issue of declaration. It is necessary to provide a complete list of required documents and information for filing the declaration. If false information is provided, administrative liability arises in the form of a fine, and in some cases the goods may be confiscated; - Compliance with the rules
of non-tariff regulation, as well as verification of the HS code. To implement customs tariff and non-tariff regulation measures, a special classification of goods is used; - Checking the correctness
of the declared customs value. Often, cargo owners enter incorrect data on the value of the goods in the declaration. Customs authorities have the right to require documents that confirm the value of the goods. In addition, if they have doubts, it is possible to send a request to the competent regulatory authorities of the country from which the goods were exported; - Payments
. At the moment of actual crossing of the border, the owner of the goods is obliged to pay import customs duties and taxes; - Currency control
. It is necessary to transfer foreign currency earnings within the established time frame to the accounts of banks that have signed transaction passports under the relevant foreign trade contracts. - Checking payments
according to the declaration. Benefits and their justification are determined, the presence of arrears in payments is checked, and, if necessary, penalties for late payments are established. - Inspection and release
. The final stage, at which a personal inspection of the cargo is carried out and its results are recorded. If everything is normal, then permission is given to release the product, otherwise, the reasons for the ban are indicated.

Clearance times at customs
The timing of clearance procedures at customs points for cargo is regulated by the Customs Code of the Customs Union:
- If temporary storage of cargo is necessary at a customs point, you can leave your goods for a period of no more than 2 months (Article 170). Extension of the deadline is permitted upon written application (but not more than 6 months).
- In Art. 185 states that before the end of the maximum storage period for cargo, it is necessary to submit a declaration on the transported products.
- 1 working day is allotted for the release of goods from the country, subject to the successful completion of permit procedures (Article 196).
In some cases, it is possible to use a simplified registration procedure. In these situations, the time frame is reduced and cannot be more than 3 days. The maximum period for extending the deadline is up to 24 hours. The norm applies to perishable products, cargo needed to eliminate emergencies, and military property. This category includes animals and express cargo, materials containing explosive elements, parcels in the form of humanitarian aid and media materials, engines with other spare parts for repairing cars and other types of vehicles engaged in international transport.

What documentation will be needed or how to obtain a declaration for the goods?
To clear the cargo, importers and exporters must provide all documents related to the delivery. Their list may vary and depends on the intended import-export operations, the characteristics of the goods being transported, and the chosen customs procedure. Typically, the following information may be needed:
- Documents on registration of a legal entity that imports or exports;
- Certificate of registration with the tax service;
- International contract, invoice, specification;
- Waybills;
- Permitting documentation (certificates/declarations of conformity for goods, FSTEC conclusion, permission of the copyright holder, if necessary, etc.);
- Insurance contract, if the delivery provides for it.
This list can be supplemented with one document or another: it all depends on the specifics of the operation being carried out. In some places, a statement with references to the norms of EAEU law will be enough, but in others, you will need to contact special institutions for additional documents (for example, FSTEC, FSB, Ministry of Culture, Rosakkreditatsiya). All papers that are needed for customs clearance of goods are provided in a formalized form, because the submission of the declaration and related documents occurs electronically.
Do I really need a customs broker?
You can take two-day courses on the Internet on self-declaration, submit your first declaration and pick up big shots: most foreign trade participants, including our regular clients, have this experience. As a rule, this experience ends the same way: adjustments in customs value, cargo delays because suddenly missing documents have to be collected, cases of administrative violation, unexpected expenses and the bitter exhalation of “never again.”
