Marking of footwear by means of identification

The procedure for marking goods with identification means unified within the Eurasian Economic Union (hereinafter referred to as the EAEU) is determined by the Agreement on the labeling of goods with identification means in the EAEU (concluded in Almaty on February 2, 2021) (hereinafter referred to as the Agreement).

Mandatory labeling of shoes according to the Government decree is carried out in stages:

• From July 1, 2021, registration of participants in the system and descriptions of goods begins;
• From October 1, 2021 - the beginning of receiving codes for labeled products, simplified labeling of shoe remnants;
• From March 1, 2021 - control of turnover, ban on the sale of unmarked shoes, registration of all transactions in the system;
• Before April 1, 2021 - labeling of remaining shoes purchased before March 1, 2021, but received after this date.
• Until May 1, 2021 - if, as of March 1, 2020, there were unsold footwear products put into circulation before March 1, 2020.*

About responsibility

In case of failure to comply with product labeling requirements, manufacturers, suppliers and sellers may incur administrative and criminal liability.

The production of unlabeled products subject to mandatory labeling by a manufacturing organization or individual entrepreneur shall entail the imposition of an administrative fine:

• against officials in the amount of five thousand to ten thousand rubles with confiscation of the items of the administrative offense;
• for legal entities - from fifty thousand to one hundred thousand rubles with confiscation of the items of the administrative offense.

Sale of products without labeling provided for by the legislation of the Russian Federation entails the imposition of an administrative fine:

• on citizens in the amount of two thousand to four thousand rubles with confiscation of the items of the administrative offense;
• for officials - from five thousand to ten thousand rubles with confiscation of the items of the administrative offense;
• for legal entities - from fifty thousand to three hundred thousand rubles with confiscation of the items of the administrative offense. According to Art. 15.12 “Code of the Russian Federation on Administrative Offences”

The production, acquisition, storage, transportation and sale of unmarked goods in large and especially large quantities is criminally punishable under Article 171.1 of the Criminal Code of the Russian Federation.

Scheme of work

1. The manufacturer receives codes from a labeling system and applies them to each box of shoes.
2. Upon shipment, the manufacturer sends the distributor via EDI a universal transfer document (UDD) indicating all the codes from the boxes.
3. Upon acceptance, the distributor checks the codes indicated in the document and on the packages, approves the UPD and transmits the data to the labeling system through the EDI operator.
4. Processing of shipment by the distributor and acceptance at retail proceed in the same way.
5. When selling, the cashier scans the labeling code from the box, the fiscal data operator adds it to the receipt and sends it to the labeling system. The code is being retired.

Now, when put into circulation, footwear products are marked with identification means - the Data Matrix code - and information is also submitted to the product monitoring system.

In what cases are companies required to obtain labeling codes to put goods into circulation?

1. Production of new goods (the code is applied before shipment from the production area),
2. Import of goods into the territory of the Russian Federation,
3. When imported from the territory of the EAEU (before importation into the territory of the Russian Federation),
4. When importing from other countries (before being placed under customs procedures),
5. Return of goods from a buyer with a lost marking code,
6. Marking of leftovers, re-marking, for example, in case of loss/damage,
7. Acceptance of goods on commission from individuals.

When importing, the goods must arrive into the territory of our country already marked - moreover, they must already be so by the time they arrive at the customs service. It is not a fact that small foreign manufacturers will immediately be technically able to label the product. Therefore, this task will fall on the shoulders of distributors for now.

If the importer does not have the opportunity to mark the goods before importing them into the territory of the EAEU, then in accordance with subparagraph 2 of paragraph 2 of Article 158 of the EAEU Labor Code, with the permission of the customs authority, operations may be carried out with goods placed under the customs procedure of a customs warehouse to prepare goods for sale and transportation (transportation), including labeling of goods.

The possibility of applying markings to goods under customs control in other places, including in a temporary storage warehouse, as well as after they are placed under the customs procedure of release for domestic consumption, is not provided for by the law of the EAEU.**
