Legislation of the DPR
Article 140. Purpose of customs clearance
1. The purpose of customs clearance is to certify information received during customs control of goods and vehicles that are moved across the customs border of the Donetsk People's Republic, and to formalize the results of such control, as well as statistical accounting of import into the customs territory of the Donetsk People's Republic, export beyond its borders and transit of goods and vehicles through its territory. Customs clearance is carried out by officials of the customs authority.
2. Customs clearance operations, the procedure for their implementation, as well as the forms of customs declarations and other documents that are used during the customs clearance of goods and vehicles, are determined by the republican executive body implementing state policy in the field of taxation and customs affairs.
Article 141. Place and time of customs clearance
1. Customs clearance is carried out at the locations of the relevant divisions of customs authorities during working hours, which are established by the republican executive body implementing state policy in the field of taxation and customs affairs.
2. Customs clearance at checkpoints across the customs border of the Donetsk People's Republic is carried out around the clock.
3. Customs clearance of goods and vehicles that move through the territory of the Donetsk People's Republic in transit mode is carried out by the customs authority at the place of import of these goods and vehicles into the customs territory of the Donetsk People's Republic.
4. Areas of territory with a complex of buildings, structures, engineering and technical means and communications necessary for customs control and clearance of goods and vehicles that move across the customs border of the Donetsk People's Republic - cargo customs complexes, auto ports, auto terminals are determined by the republican executive body implementing state policy in the field of taxation and customs affairs. The cargo customs complex, auto port, auto terminal may be part of the customs authorities of the Donetsk People's Republic or owned by a resident business entity registered in the manner established by the legislation of the Donetsk People's Republic.
5. The opening of cargo customs complexes, auto-ports, auto-terminals by business entities is carried out in agreement with the Department of Customs Affairs. The requirements that the cargo customs complex, auto port, and auto terminal must meet are determined by the republican executive body implementing state policy in the field of taxation and customs.
6. Customs clearance of goods and vehicles that are exported outside the customs territory of the Donetsk People's Republic by citizens can be carried out at any customs authority throughout the customs territory of the Donetsk People's Republic.
7. Customs clearance of goods (except for those transported in unaccompanied baggage), as well as vehicles for personal use that are imported into the customs territory of the Donetsk People's Republic by citizens, is carried out at checkpoints across the customs border of the Donetsk People's Republic.
8. Customs clearance of goods that are imported into the customs territory of the Donetsk People's Republic by citizens in unaccompanied luggage is carried out by customs authorities at the place of residence or temporary stay of these citizens.
9. Places for customs clearance of vehicles for personal use that are imported into the customs territory of the Donetsk People's Republic by citizens are determined by the republican executive body implementing state policy in the field of taxation and customs affairs.
10. Upon a written application of the declarant or a person authorized by him, customs clearance may be carried out by customs authorities outside the location of the customs authorities or outside the working hours established by the republican executive body implementing state policy in the field of taxation and customs affairs.
11. For customs clearance of goods and vehicles outside the location of customs authorities or outside the working hours established for customs authorities, customs authorities collect fees from interested parties in the manner and in the amounts established by this Law.
Article 142. Beginning of customs clearance
1. Customs clearance begins after submitting to the customs authority all the documents and information required for customs control and execution of documents and information regarding goods and vehicles subject to customs clearance.
2. Certification by the customs authority of the acceptance of goods, vehicles and documents on them for customs control and customs clearance is carried out by placing marks on the relevant shipping documents.
Article 143. Presence of the declarant or a person authorized by him during customs clearance
At the request of the customs authority, interested persons or their representatives are required to be present during customs clearance.
Article 144. Time limits for customs clearance
1. Customs clearance is carried out by the customs authority, as a rule, within one day from the time of presentation of goods and vehicles that are subject to customs clearance, submission of all necessary documents and information.
2. The period for customs clearance may be extended by the time necessary to complete all customs formalities in order to complete customs clearance.
Article 145. Language in which customs clearance is carried out
Customs clearance, including filling out the documents required for customs clearance, is carried out in Russian. The republican executive body implementing state policy in the field of taxation and customs affairs has the right to determine other cases in which customs authorities can accept and use for customs purposes documents and information in foreign languages spoken by customs officials. Customs authorities have the right to require the declarant to translate documents drawn up in foreign languages if the data contained in them is necessary to verify or confirm the information specified in the cargo customs declaration.
Article 146. Priority procedure for customs clearance
When importing into the customs territory of the Donetsk People's Republic and exporting from this territory goods necessary to eliminate the consequences of natural disasters, accidents and catastrophes, as well as goods subject to rapid spoilage, live animals, radioactive materials, humanitarian and technical assistance, materials for the media and other similar goods, customs clearance is carried out as a matter of priority.
Article 147. Completion of customs clearance
1. Customs clearance is considered completed after the customs authority has completed the customs procedures determined by it on the basis of this Law in accordance with the declared customs regime, by affixing the appropriate stamps of customs security on the customs declaration or a document that replaces it, on shipping and transport documents, as well as after sanitary-epidemiological, quarantine, phytosanitary, veterinary and other types of control of the import of goods into the customs territory of the Donetsk People's Republic or their export from this territory, if the goods are subject to such control, in accordance with the legislation of the Donetsk People's Republic.
2. If a violation of customs rules is detected during the customs clearance process, the customs authority releases the goods before making a decision on the case of such a violation, provided that such goods are not subject to confiscation or will not be needed in the future in the inquiry process as evidence.
Article 148. Refusal of customs clearance
1. Refusal of customs clearance is a written reasoned decision of the customs authority about the impossibility of carrying out customs clearance of goods and vehicles due to failure by the declarant or his authorized person to comply with the conditions and requirements of this Law.
2. The decision to refuse customs clearance must indicate the reasons for the refusal with reference to the norms of the legislation of the Donetsk People's Republic, as well as comprehensive explanations of the requirements, the implementation of which will ensure the possibility of customs clearance of goods and vehicles.
Certification of goods in the Russian Federation
