2. (A) Goods classified in Chapters 50 to 55 or in heading 58.09 or 59.02 and consisting of a mixture of two or more textile materials shall be classified according to the textile material which predominates by weight over any other textile material in that material. product.
If no textile material predominates by weight, then such goods must be classified according to the textile material included in the heading, the last in ascending order of codes among the headings in question.
(B) When applying the above rule:
(a) gimped horsehair thread (heading 51.10) and metallized thread (heading 56.05) are to be treated as a single textile material, the mass of which is taken to be the sum of the masses of its components; when classifying fabrics, metal thread should be considered as a textile material;
(b) in selecting a suitable heading, the group is first determined, and then the corresponding heading within that group, without taking into account materials that are not included in the group;
(c) where both groups 54 and 55 are associated with any other group, they are to be treated as a single group;
(d) where a group or heading includes goods of different textile materials, such materials are to be treated as a single textile material.
(B) The provisions contained in notes 2 (A) and 2 (B) above also apply to the classification of yarns referred to below in notes 3 (A, B), 4 (A, B), 5 or 6.
3. (A) For the purposes of this section, subject to the exceptions set forth in Note 3 (B) below, yarn (single, multi-ply (spun), or single-ply) described hereinafter shall be considered as "string, cordage, ropes and cables" :
(a) from silk threads or silk waste, linear density exceeding 20,000 dtex;
(b) from man-made filaments (including filaments of two or more monofilaments of group 54) of a linear density of more than 10,000 dtex;
(c) from hemp or flax fibers:
(i) polished with a linear density of 1429 dtex or more; or
(ii) unpolished with a linear density of more than 20,000 dtex;
(d) from coconut fibers in three or more layers;
(e) from other plant fibers with a linear density of more than 20,000 dtex; or
(f) reinforced with metal thread.
(B) Exceptions:
(a) yarn of wool or other animal hair and paper yarn, other than yarn reinforced with metallic filament;
(b) a tow of chemical yarns of group 55 and a filament thread without twist or with a twist of less than 5 cr/m of group 54;
(c) fiber from the silkworm glands of heading 5006 and monofilament of Chapter 54;
(d) metallized threads of heading 56.05; metallic filament reinforced yarn is included in accordance with Note 3(A)(e) above; And
(e) chenille yarn, gimped yarn and fancy loop yarn of heading 56.06.
4. (A) For the purposes of Chapters 50, 51, 52, 54 and 55, subject to the exceptions specified in Note 4 (B) below, the term “put up for retail sale” means yarn (single, multi-ply (spun) or single-ply):
(a) on cardboard plates, reels, cartridges or similar carriers, weighing not more than (including the weight of the carrier):
(i) 85 g – for silk threads, silk waste or chemical threads; or
(ii) 125 g – for other yarns;
(b) in balls, skeins or skeins weighing no more than:
(i) 85 g - for chemical threads with a linear density of less than 3000 dtex, silk threads or silk waste;
(ii) 125 g - for other yarns with a linear density of less than 2000 dtex; or
(iii) 500 g – for other yarns;
(c) in skeins or skeins comprising several smaller skeins or skeins separated by threads which make them independent of each other, each of these smaller skeins or skeins weighing not more than:
(i) 85 g – for silk threads, silk waste or chemical threads; or
(ii) 125 g – for other yarns.
(B) Exceptions:
(a) single yarn of any textile material other than:
(i) single-strand unbleached yarn of wool or fine animal hair; And
(ii) single yarn of wool or fine animal hair, bleached, dyed or printed, of a linear density of more than 5,000 dtex;
(b) multi-ply (spun) or single-ply yarn, unbleached:
(i) from silk threads or silk waste, packaged; or
(ii) of textile material other than yarn of wool or fine animal hair, in skeins or skeins;
(c) multiply (spun) or single-ply yarn of silk or silk waste, bleached, dyed or printed, of 133 dtex or less; And
(d) single, multi-ply (twisted) or single-ply yarn of any textile material:
(i) in skeins or cross-wound skeins; or
(ii) wound on carriers or in any other manner indicating its use in the textile industry (for example, in cobs, on spinners and spools, in conical bobbins or on spindles or in the form of cocoons for embroidery machines).
5. In headings 5204, 5401 and 5508, the term “sewing thread” means multi-twisted or single-twisted yarn:
(a) packaged on carriers (for example, spools, cartridges) with a mass (including the weight of the carrier) not exceeding 1000 g;
(b) finished for use as sewing thread; And
(c) with finite right twist.
6. In this section, the term “high tenacity yarn” means a yarn with a relative breaking strength, measured in cN/tex (centinewtons per tex), greater than:
single-strand yarn of nylon or other polyamides or polyesters 60 cN/tex;
multi-twisted or single-twisted thread made of nylon or other polyamides or polyesters 53 cN/tex;
single-ply, multi-ply (twisted) or single-ply yarn made of viscose fiber 27 cN/tex.
7. In this section, the term “ready-made” means:
(a) cut, but not in the shape of squares or rectangles;
(b) presented in a complete form, suitable for use (or requiring only separation by cutting the separating threads) and not requiring sewing or other processing (for example, napkins, towels, tablecloths, scarves, blankets);
(c) cut to size and having at least one thermally sealed edge with a visible folded or pressed edge and other edges processed as described in any other subclause of this note, but excluding materials in which the cut edges are protected from fraying by thermal cutting or in another simple way;
(d) hemmed or with folded edges or with knotted fringe on any of the edges, but excluding materials in which the cut edges are protected from fraying by stitching or other simple means;
(e) cut to size and edges processed by pulling out threads;
(f) sewn, glued or otherwise joined (except for pieces consisting of two or more panels of identical material sewn edge to edge, and pieces consisting of two or more textile materials joined in layers, with or without a soft layer );
(g) knitted by machine or hand in shape, presented in the form of individual products or in the form of several connected products.
8. In groups 50 – 60:
(a) Chapters 50 to 55 and 60 and, unless the context otherwise requires, Chapters 56 to 59 do not include goods that are finished in accordance with Note 7 above; And
(b) groups 50 – 55 and 60 do not include goods of groups 56 – 59.
9. Fabrics of groups 50 – 55 include fabrics consisting of layers of parallel textile threads located one above the other at sharp or right angles. These layers are held together at the intersections of the threads with an adhesive or thermal compound.
10. Elastic products consisting of textile materials in combination with rubber threads are included in this section.
11. In this section, the term “impregnated” also means immersion treatment.
12. In this section, the term “polyamides” also applies to “aramids”.
13. In this section and, where applicable, throughout the Nomenclature, the term “elastomeric thread” means a filament thread, including monofilament, of a synthetic textile material other than a textured thread that does not break when stretched to three times its original length and which, when stretched to twice its original length in a period of five minutes, returns to a length not more than one and a half times its original length.
14. Unless the context otherwise requires, articles of textile apparel falling under different headings are to be classified under their respective headings even if presented in sets for retail sale. In this note, the term “garments of textile materials” means garments covered in headings 6101 to 6114 and 6201 to 6211.
Notes to subheadings:
1. In this section and, where applicable, throughout the Nomenclature, the following terms mean:
(a) unbleached yarn:
(i) having the natural color of the fibers composing it and not subjected to bleaching, dyeing (whether or not bulk) or printing; or
(ii) having an indeterminate color (“harsh yarn”), made from spun raw materials.
Such yarn can be treated with a colorless sizing agent or a non-persistent dye (disappearing after a simple wash with soap), and in the case of chemical fibers, it can be treated in bulk with a matting agent (for example, titanium dioxide).
(b) bleached yarn:
(i) subjected to a bleaching process, made from bleached fibers or, unless the context otherwise requires, dyed white (whether or not bulk) or treated with a white sizing;
(ii) consisting of a mixture of unbleached and bleached fibers; or
(iii) multiply (twisted) or single-ply yarn consisting of unbleached and bleached threads.
(c) colored (dyed or printed) yarn:
(i) dyed (whether or not bulk) of a color other than white or a non-fast colour, or printed, or made from dyed or printed fibres;
(ii) consisting of a mixture of dyed fibers of different colors or of a mixture of unbleached or bleached fibers with dyed fibers (two-color roving yarn or mélange yarn) or printed yarn in one or more colors at intervals to give the impression of dots;
(iii) obtained from printed sliver or roving; or
(iv) multi-ply (spun) or single-ply yarn, consisting of unbleached or bleached yarn and dyed yarn.
The above definitions also apply mutatis mutandis to monofilaments and flat or similar threads of group 54.
(d) unbleached fabrics:
made from unbleached yarn and not bleached, dyed or printed. Such fabrics can be subjected to colorless finishing or dyeing with unstable dyes.
(e) bleached fabrics:
(i) bleached or, unless the context otherwise requires, painted or treated with white size, in the piece;
(ii) made from bleached yarn; or
(iii) made from unbleached and bleached yarn.
(f) dyed fabrics:
(i) fabrics, plain dyed, other than white (unless the context otherwise requires), or colored finished, other than white (unless the context otherwise requires), in a piece; or
(ii) made from plain dyed yarn.
(g) fabrics made from yarn of various colors (except printed fabrics):
(i) made from yarn of different colors or yarn of different shades of the same color (other than the natural color of the constituent fibers);
(ii) made from unbleached or bleached yarn and dyed yarn; or
(iii) made from two-color or mélange yarn.
(In all cases, the threads forming the edge or end of the fabric are not taken into account.)
(h) fabrics printed:
fabrics printed in a piece, whether made from different colors of yarn or not.
(Printed fabrics also include fabrics with designs applied, for example by brush or spray, stencil, flocking or batik.)
Mercerization does not affect the classification of yarns or fabrics according to the above definitions.
The definitions set out above in the notes to subheadings 1 (d) - 1 (h), when appropriate changes are made, are applicable to knitted or crocheted fabrics.
(i) plain weave fabrics:
fabrics in which each weft thread passes alternately over and under successive warp threads and each warp thread passes alternately over and under successive weft threads.
2. (A) Articles of groups 56 to 63 containing two or more textile materials are considered as articles consisting entirely of that textile material which, in accordance with Note 2 to this section, must be selected for classification as an article consisting of the same textile materials. to groups 50 - 55 or heading 5809.
(B) Using the above rule:
(a) where applicable, only the part determining the classification in accordance with Fundamental Rule of Interpretation 3 shall be taken into account;
(b) the background fabric is not taken into account if the textile product consists of a background fabric and has a pile or loop surface;
(c) in the case of embroidery of heading 58.10 and articles thereof, only the background fabric is taken into account. However, embroidery without a visible background and products made from it should be classified only by the embroidery threads.
