On approval of the Regulations on the system of performance indicators of the customs authorities of the Russian Federation, the procedure and methodology for their monitoring

In accordance with Part 2 of Article 18 of the Federal Law “On Customs Regulation in the Russian Federation,” the Government of the Russian Federation decides:
1. Approve the attached Regulations on the system of performance indicators of the customs authorities of the Russian Federation, the procedure and methodology for their monitoring.

2. This resolution comes into force 30 days after the day of its official publication.

REGULATIONS on the system of performance indicators of the customs authorities of the Russian Federation, the procedure and methodology for their monitoring

1. These Regulations determine the system of performance indicators of the customs authorities of the Russian Federation, the procedure and methodology for their monitoring, as well as the procedure for participation in such monitoring of all-Russian non-profit organizations that unite persons carrying out activities related to the import of goods into the Russian Federation and their export from the Russian Federation, as well as persons carrying out activities in the field of customs, determined by the Government of the Russian Federation in accordance with Part 3 of Article 53 of the Federal Law “On Customs Regulation in the Russian Federation” (hereinafter referred to as customs authorities, all-Russian non-profit organizations).

2. The system of indicators of the work of customs authorities is a set of interrelated indicators that represent quantitatively expressed characteristics of the main criteria for assessing the work of customs authorities specified in Part 1 of Article 18 of the Federal Law “On Customs Regulation in the Russian Federation”.

3. The system of performance indicators of customs authorities includes:

main performance indicators of customs authorities according to the appendix (hereinafter referred to as the main indicators);

performance indicators of regional customs departments and performance indicators of customs offices and customs posts, determined by the Federal Customs Service.

4. The relationship between the performance indicators of customs authorities is determined by the fact that each criterion specified in Part 1 of Article 18 of the Federal Law “On Customs Regulation in the Russian Federation” corresponds to a group of basic indicators that are cumulative in relation to the performance indicators of regional customs departments and the performance indicators of customs offices and customs posts.

5. Monitoring the performance indicators of customs authorities is the collection, synthesis and analysis of information on the results of the work of customs authorities, as well as assessment of the implementation of indicators.

Analysis of the results of the work of customs authorities is carried out by comparing the values ​​of indicators achieved in the reporting period with indicators achieved in previous periods.

The assessment of the performance of indicators is formed based on the results of a comparative analysis.

6. Monitoring of performance indicators of customs and customs posts is carried out by regional customs departments and customs houses, respectively.

Monitoring of performance indicators of regional customs departments is carried out by the Federal Customs Service.

Monitoring of key indicators is carried out by the Federal Customs Service based on an assessment of the performance indicators of regional customs departments.

7. Monitoring of key indicators, performance indicators of regional customs departments and performance indicators of customs offices and customs posts is carried out quarterly.

Customs posts submit reports on the implementation of customs post performance indicators to the higher customs office no later than the 7th day of the month following the reporting quarter (in the 4th quarter - no later than January 12 of the year following the reporting quarter).

Based on the results of the analysis of the submitted reports, customs evaluates the work of customs posts, generates a report on the implementation of customs performance indicators and sends it to the higher regional customs department no later than the 12th day of the month following the reporting quarter (in the fourth quarter - no later than January 17 of the year, following the reporting one).

Based on the results of the analysis of the submitted reports, the regional customs department evaluates the work of customs offices, generates a report on the performance indicators of the regional customs department and sends it to the Federal Customs Service no later than the 20th day of the month following the reporting quarter (in the IV quarter - no later than January 25 year following the reporting year).

Based on the results of the analysis of reports from regional customs departments, the Federal Customs Service evaluates their work and also prepares a report on the implementation of key indicators no later than the 12th day of the 2nd month following the reporting quarter (in the IV quarter - no later than February 17 of the year following for reporting).

8. A report on the performance of key indicators is posted on the official website of the Federal Customs Service on the Internet information and telecommunications network (hereinafter referred to as the official website) quarterly, no later than the 15th day of the 2nd month following the reporting quarter (in the 4th quarter - no later than February 20 of the year following the reporting year).

A report on the performance of key indicators is sent to the Government of the Russian Federation annually, no later than February 20 of the year following the reporting year.

9. All-Russian non-profit organizations, based on a report on the performance of key indicators posted on the official website, as well as other information at their disposal, can prepare a conclusion containing comments and suggestions (hereinafter referred to as the conclusion).

All-Russian non-profit organizations send a conclusion to the Federal Customs Service no later than the 30th day of the month following the day the report on the performance of key indicators is posted on the official website.

The conclusion is posted on the official website no later than 5 working days from the date of its receipt by the Federal Customs Service.

The conclusion is considered by the Federal Customs Service with the participation of representatives of all-Russian non-profit organizations at a joint meeting no later than the 30th day of the month following the day the all-Russian non-profit organizations sent the conclusion to the Federal Customs Service.

Based on the results of the joint meeting, a protocol is drawn up that reflects the decisions made, including on the advisability of checking the information and facts set out in the conclusion and taking response measures, on preparing proposals to amend the customs legislation of the Customs Union and the legislation of the Russian Federation on customs affairs, as well as on amendments to legal acts of the Federal Customs Service.

10. The minutes of the joint meeting provided for in paragraph 9 of these Regulations are posted on the official website no later than 15 working days from the date of the joint meeting.

APPENDIX to the Regulations on the system of performance indicators of the customs authorities of the Russian Federation, the procedure and methodology for their monitoring

Key performance indicators of the customs authorities of the Russian Federation

1. In order to determine the speed of customs operations when importing goods into the Russian Federation and their export from the Russian Federation, as well as reducing the costs of interested parties when performing customs operations, the following indicators are used:

a) time of performance by the customs authorities of the Russian Federation (hereinafter referred to as the customs authorities) of operations related to the implementation of state control at automobile checkpoints (minutes):

for goods subject to veterinary, phytosanitary and sanitary quarantine control;

for other goods for which no risks of violations have been identified;

b) the time elapsed from the moment of completion of the customs procedure for customs transit of goods, the transportation of which under customs control is carried out by road, from the customs authority at the place of arrival to the internal customs authority until the moment of release of goods in accordance with the customs procedure for release for domestic consumption (minutes), except in the following cases:

placing goods in temporary storage;

failure to comply with the provisions established by Articles 190 - 192 of the Customs Code of the Customs Union;

failure by the declarant to fulfill the conditions for the release of goods (Article 195 of the Customs Code of the Customs Union);

c) the share of declarations for goods issued electronically without submitting documents on paper, in the total number of completed declarations for goods, provided that the goods (vehicles) are not identified as risky supplies requiring additional verification of documents on paper (percentage) ;

d) the share of the cost of goods issued electronically without submitting paper documents in the total cost of goods issued, provided that the goods (vehicles) are not identified as risky deliveries requiring additional verification of paper documents (percentage).

2. In order to determine the timeliness and completeness of receipt of customs payments, the following indicators are used:

a) the level of fulfillment of the forecasted target for revenues administered by customs authorities to the federal budget (percent);

b) the share of customs duties returned to payers in connection with the satisfaction of complaints from participants in foreign economic activity about the decision, action (inaction) of the customs authority or its official, in the total amount of customs duties paid (percent);

c) the share of customs payments returned to payers or offset against future payments based on court decisions canceling illegal decisions of customs officials in the total volume of customs payments paid (percent).

3. In order to determine the effectiveness of combating crimes and administrative offenses, the following indicators are used:

a) the share of consignments of imported (exported) goods in respect of which customs inspection was carried out in the total number of consignments in respect of which a declaration for goods was filed (percent);

b) the share of goods consignments subjected to customs inspection, as a result of which violations of the customs legislation of the Customs Union and the legislation of the Russian Federation on customs affairs were identified, or as a result of which the release of goods was refused, in the total volume of inspected consignments of goods (percent);

c) the share of successful customs inspections after the release of goods in the total number of completed customs inspections (percentage).
