Example of calculation and determination of customs duties during customs clearance of fabrics

Let's look at a simple example of calculating customs duties. The recipient is a legal entity that imports a batch of ZARA HOME bed linen into the territory of the Russian Federation. The calculation is carried out within the framework of the IM-40 regime (Release for domestic consumption). The customs cost of the shipment, which includes delivery to the border, is 6,000 Euro.

According to the HS code 6302 31 000 9, the duty rate is 0.49 euros/kg, VAT 20%, not subject to excise tax.

Customs payments are calculated from the customs value according to the following formula:

Customs value (hereinafter referred to as CV) = the cost of the goods under the contract + the cost of transporting the goods to the border with Russia (transportation within Russia is not taken into account).

The Euro exchange rate on the date of filing the declaration is 78 rubles TC = 6,000 Euro * 78 = 468,000 rubles. Duty rate 0.49 euros/kg = (1,500 * 0.49) * 78 = 57,330 rubles.

VAT = 20% of the vehicle + customs duty

VAT = (468,000 + 57,330) * 20 / 100 = 105,066 rub.

At customs, a fixed customs duty is paid, which has its own calculation formula:

TS of goodsCustoms duty amount
does not exceed 200 thousand rubles inclusive500 rubles
From 200,000 rubles 1 kopeck or more, but does not exceed 450,000 rubles inclusive1,000 rubles
From 450,000 rubles 1 kopeck or more, but does not exceed 1,200,000 rubles inclusive2,000 rubles
From 1,200,000 rubles 1 kopeck or more, but does not exceed 2,500,000 rubles inclusive5,500 rubles
From 2,500,000 rubles 1 kopeck or more, but does not exceed 5,000,000 rubles inclusive7,500 rubles
From 5,000,000 rubles 1 kopeck or more, but does not exceed 10,000,000 rubles inclusive20,000 rubles
From 10,000,000 rubles 1 kopeck or more30,000 rubles

Customs payments = VAT + Customs duties + Customs duties

Total payable = 105,066 (VAT) + 57,330 (Duty) + 2,000 (Fee) = 164,396 rubles

The given results of calculation of customs duties are for informational purposes only and are not final. The actual amount may differ depending on the country of origin, HS code, exchange rate and other economic and political factors.

Peculiarities of import and customs clearance of adult and children's clothing by individuals

Recently, in the era of Internet globalization, our citizens have been purchasing a large number of adult and children's clothing in foreign online stores in the countries of China, Turkey, the USA and Europe (Germany, Italy, Great Britain, France, Poland, etc.) which carry out or organize delivery of goods to Russia using international express carriers such as: EMS, TNT, DHL, UPS and others. It must be remembered that when importing goods in 2021 with a total weight of up to 25 kg and a cost not exceeding 500 euros (from 2020, the cost norm will be reduced to 200 euros per month) and not related to commercial consignments, customs duties are not subject to payment. But there are cases when customs detains a parcel at the place of customs clearance and sends a notification to the recipient about the need to appear and pay the necessary customs duties in case of exceeding the permitted import standards, in which case the customs duty will be 30% of the amount exceeding the permissible value, or 4 euros for each kilogram of weight. In such cases, the recipient can contact our company for help and we will help you find a legal solution for clearing your goods at customs!

Deadlines for customs clearance

The established period for filling out and submitting a declaration for fabric ranges from several hours to 2 working days and depends on the type of cargo, the number of items in the invoice and the number of EAEU HS codes.

The customs authority checks and releases the declaration within a few hours from the moment of its registration, if no changes are required to the declaration and all permits are provided. There are also other reasons for delay, which our company, having extensive experience, minimizes, thereby saving time and money for its clients.

Any deviation from the planned delivery time of goods and customs clearance is fraught with downtime and additional costs for the foreign trade participant, which is why it is important to minimize all risks of increasing customs clearance times.

Stages of passing control

To get started, specialists will need the following information:

  • list of nomenclature;
  • number of units of each article;
  • actual cost.

If the cargo is picked up from the supplier’s warehouse by our transport company, then the necessary data and papers can be requested from him. If customs clearance is carried out for fabric from Turkey, fur products, antiques, luxury furniture and rare wood species, additional documents will most likely be required confirming the origin and quality of the products.

After collecting a package of documents and checking them for compliance with the legislation of the Russian Federation, declarations are filled out and the imported items are classified according to the Commodity Nomenclature of Foreign Economic Activity.

The competence of specialists includes support during control and inspection by FCS inspectors. In other words, during control, our employees will act as your representatives and protect your interests and rights.

This is only a small part of Turkish clothing manufacturers. On the territory of Istanbul alone there are a great many factories, as well as offices of resellers. To find a supplier in Istanbul, you need to navigate the city areas correctly. Leather and fur are concentrated in Zeytinburnu, evening dresses in Osmanbey, jeans and branded imitation in the Merter-Güngören area, knitwear in the Bayrampasa area, cheap clothes in the Beyazit and Fatih areas. The Laleli district is very popular among wholesale buyers, but resellers mostly work there, as in the Aksaray district. Prices in these areas are often inflated.

Zeytinburnu is home to a huge number of manufacturers of excellent quality leather goods, as well as manufacturers of fur clothing. Some clothes are sewn by hand, some factories work to order. The cost of products depends on the material. Chinese mink is cheaper, chinchilla is more expensive. You can also purchase products made from cat, raccoon, beaver, lynx, and rabbit. The cost of fur coats is from 400 to 2000 dollars. Prices for leather products start at $150.

Turkish factories, as a rule, have an office and a store next to the workshops. The store works with both wholesale and retail customers. In winter and summer there are discount seasons in stores. Prices are sometimes reduced by 70 percent.

In many areas, you can buy counterfeit goods with logos of famous brands, although the production and sale of such items is prohibited. When exporting batches of counterfeit clothing, problems may arise at customs.

On the Internet you can find intermediaries who help you find suppliers and manufacturers in Turkey. Intermediaries invite Russian entrepreneurs to formulate a request and leave contact information. This information is translated into Turkish and sent to factories. Factory representatives are contacting the Russian side. The service is free for the buyer; it is paid for by the Turkish manufacturer.

How to conduct business negotiations correctly

First of all, it should be remembered that Turkish entrepreneurs love to bargain and the first price is set in order to bring it down. You need to be prepared for this and be ready for negotiations. To have a good idea of how much a product actually costs, it’s worth studying the entire range of offers and talking with different suppliers. The more information, the easier it is to negotiate.

During negotiations, the person who is older in age or rank is greeted first. It is customary to greet people with a handshake; when saying goodbye, you can also shake hands, although this is not particularly common.

The business card is handed to the secretary at the reception. If the reverse side of the card is in Turkish, this will indicate serious intentions and will make a pleasant impression on partners.

Business meetings often start later than agreed upon; punctuality is not the strong point of the Turkish people. Late arrivals of foreign partners are also tolerated. Negotiations can take place during dinner; they are always preceded by a polite conversation on general topics: about the weather, the culture of the country, sights. During a conversation, you can be distracted by calls, this will not violate etiquette.

The dinner is paid for by the person who invited. You may politely offer to pay the bill, but this offer will not be taken seriously. As a thank you for dinner, you can host a return dinner. It is customary to give gifts only if you are invited to dinner at home. A traditional gift is delicious sweets. Alcohol is usually not given as a gift, since Türkiye is a Muslim country.

You should wear a suit to a business meeting. In hot weather, you can limit yourself to a shirt and trousers. In the Turkish provinces, a woman must wear formal business attire that covers her arms and legs.

Export of goods from Turkey. Preparation of documents.

To transport goods to Russia, you can use the services of many cargo companies, whose offices can easily be found in the Laleli and Aksaray districts of Istanbul. Sending clothes by land costs about 10 dollars per kilogram, and by plane – about 14-15 dollars per kilogram of goods. When concluding an agreement with the carrier, the client is assigned an identification number that can be used in all subsequent transactions. The carrier contacts the manufacturer from whom the clothes were purchased, picks up and packages the goods, draws up documents, and takes care of all the customs clearance of the goods. It is recommended to insure the cargo. The cost of insurance is 2-3 percent of the cost of the goods. Products are usually delivered to Moscow or Pyatigorsk, and then transferred to a domestic carrier. On average, delivery takes two weeks.

A foreign economic contract is concluded with the supplier. This document is drawn up based on the requirements imposed by currency, customs and tax control authorities. The “Subject of the contract” section contains a complete description of the goods (assortment, size, weight, volume, country of origin), this is important for correct classification in accordance with the Commodity Nomenclature of Foreign Economic Activity. In the “Contract Amount” section, the total transaction value and the price per unit of goods are indicated, as well as the name and code of the currency in accordance with the currency classifier. All this data is entered into the transaction passport, as well as the terms of payment. The contract currency and the payment currency may differ; this must be noted in the transaction passport, indicating the code and name of the payment currency. The contract is not considered concluded if the delivery time is not specified; this data is verified by exchange control. In the “Banking expenses” section it is stated who pays for the services of intermediary banks, so that there are no misunderstandings with violation of currency control if the proceeds are not fully credited to the account. A mandatory clause of the contract is “Dispute Settlement”. It is indicated which country’s legislation is applied when resolving disputes, where disputes are considered, and in what language. Further, it is necessary to provide for sanctions for non-compliance with the terms of the agreement.

To carry out customs clearance of cargo, you need to obtain a Declaration of Conformity for the goods, for which the goods are grouped by type, composition, belonging to men's and women's clothing, according to the HS code. All clothing for adults and children, including underwear, is subject to declaration of conformity, that is, a certificate of conformity is required. This procedure is carried out by Russian product certification centers.

Certification of clothing is carried out in this way. The customer provides product samples and the following documents to the certification center: a copy of the contract, copies of constituent documents, a manufacturer’s quality certificate, an application. Since clothing is divided into groups, one certificate is often not enough. Each group has its own GOST, including men's and women's clothing. A separate certificate must be issued for each group: linen knitwear (T-shirts, T-shirts, etc.), outer garments (shirts, shirts, etc.), women's outerwear in the dress and blouse range (skirts, dresses, blouses, sundresses), outer garments of the suit range (trousers, overalls, shorts, capris, jackets, suits, cardigans, vests, etc.), outer garments for coats (jackets, coats, short coats, raincoats, etc.), knitted outerwear (jumpers, sweaters, jackets, vests, sweatshirts, etc.), hosiery (stockings, socks, tights), headwear (hats, caps, Panama hats). Clothing samples undergo laboratory examination for compliance with GOST, a test report is drawn up, which is reflected in the certificate of conformity. The certificate is issued for a period of one to three years. Registration of the declaration takes 1-4 business days.

The clothing exporter must provide shipping documents (invoices, packing lists, etc.). The description of the clothing must be complete, with photographs, sizes, composition, name, address of the manufacturer, with a table of size correspondence to Russian standards attached. If the manufacturer has not previously dealt with exports to Russia, then problems may arise at this stage and specialist advice will be needed.

When a product is registered at customs, it is assigned a customs identification number (CIN), documents are checked, and duties are paid. Customs clearance of cargo is a very complex procedure. At different stages, problems may arise that a customs broker or customs lawyer can solve. If the importer does not have a specialist on his staff who is familiar with the intricacies of passing customs control, then he should definitely seek help from professionals.

Customs duties are paid in full on clothing imported from Turkey. The approximate amount of the fee can be found in the table below. On the Internet it is easy to find sites with so-called customs calculators, with the help of which you can obtain more accurate information.
