How to open an ELS for a new foreign trade participant?

All citizens who are engaged in foreign economic activity can register in the system to gain access to the ELS. If the user has not previously conducted foreign trade activities, then the legal registration of a single personal account will consist of the following steps:

  • You need to obtain an electronic signature (for this you can use the options of the official website of the State Services).
  • You should register on the FCS portal https://customs.gov.ru/, using the “Personal Account” option, which is located in the top panel.
  • To open an ELS, you need to correctly draw up the appropriate application. The official document must indicate data on the presence (absence) of subsidiaries that can declare various cargoes.
  • The prepared application should be sent by mail or online.
  • It is necessary to agree with government officials on the optimal timing for obtaining documentary evidence of verification of unspent funds and activation of the ELS.
  • At this stage, financial savings are credited to the balance sheet. Immediately after receiving the account statement, you must submit an application to transfer the remaining money to a single personal account.
  • You can send your prepared application by fax or mail. A pre-prepared copy of this document must be sent to specialists involved in the clearance of goods owned by the declarant.
  • Transfer of financial savings to ULS. Specialists need 3-5 days to transfer funds from all old accounts of the declarant to the ELS.

To clarify additional nuances, it is recommended to call the FCS hotline.

To create a new declaration procedure, you need to decide on the option for its implementation and then perform the following actions:

  1. Prepare documents. You need to fill out the required documentation and send it to the customs service.
  2. Submit and register documents. When the documents are received by the customs inspector, an investigation will be carried out into the circumstances under which the declaration was registered. Then a unique registration number is assigned.
  3. Check the DT with an inspection. This stage involves conducting a documentary check by customs officials and requesting documents confirming the information specified in the DT. Then the goods are inspected (if required).
  4. Release goods. When the documentary check is completed, the customs inspector makes a decision regarding the goods specified in the sent documentation.

Rake No. 2

When submitting a DT, it may seem logical to indicate the customs post where the parcel arrived, but having sent there, your DT will be rejected with a cover letter like this:

The bottom line is that the consideration of DT is carried out by separate customs authorities, which have no physical contact with the customs posts operating “on the ground”. For example, my parcel arrived at Vnukovo airport and was processed by customs post 10001020:

But I should submit the DT in 10005030:

Ignorance of such nuances consumed a lot of my nerves and time when submitting the first DT. By washing and rolling, trial and error.

So, a package has arrived to you. Steps for customs clearance.

Static declaration

One of the main functions and advantages of using the personal section is carrying out customs statistical declarations. This document is an official statement written in a special form and sample. It must fully comply with all established rules and conditions of the chosen customs legal regime.

To carry out the declaration procedure, you will need to choose the optimal type of operation for yourself and immediately go through the following steps:

  1. Careful preparation of papers - filling them out and then sending them to customs.
  2. Submission of documents and their legal registration. Immediately after receiving the full package of papers and certificates, the customs inspector will quickly check the rules and conditions for registering goods. Only after this the document will be assigned its own registration number.
  3. DT checks and thorough inspection are carried out. At this time, customs officers carry out a special check of documents for goods. If necessary, documents will be requested that confirm the information included in the declaration.

After the operation, the verified goods are released. This process is carried out exclusively under the guidance and order of an experienced customs inspector.

Main sections of the account

A large number of functionality presented to the subscriber is based on the presence of a large number of special thematic and functional sections. Among the most useful of them it is worth highlighting:

  • Personal account;
  • Preliminary information;
  • Currency and customs transit;
  • Electronic transit;
  • Statistical declaration.

Despite the large number of pages and tabs, the office is characterized by optimal ease of use. Its interface is simple and very easy to use. The work is carried out very quickly, and if there are interruptions, you can contact technical support staff and get answers to your questions as quickly as possible. And this despite the fact that the site does not have a return form and everything is resolved via email.

Who should not report for the movement of products across the Russian border

Citizens of the Russian Federation do not submit a statistical form for the import/export of goods intended for personal use. In addition, consular and diplomatic institutions and international organizations of countries that are members of the European Economic Union are exempt from filing it. There is no need to report for goods transported in transit or temporarily moved to the territory of another state for maintenance and repair, as well as those that were moved for a period of up to one year.

Products subject to the dissemination of regulations on state secrets do not require submission of a report. Products that legally require customs declaration do not require additional statistical recording. Exhibition equipment, product samples, and products subject to complaint are also exempt from statistical declaration. In addition, materials that support the operation of the Baikonur complex are not subject to statistical accounting.

Fine

In order to discipline participants in foreign trade activities, a system of fines is provided, which began to operate in 2021. An organization that has not submitted a statistical form or has distorted data will be fined 20–70 thousand rubles upon the first discovery of a violation. An additional fine of 10–20 thousand rubles. imposed on the head of the organization.

For repeated violations, the fine increases significantly. So, for a manager it will be 30–50 thousand rubles, and for an organization – 100–150 thousand rubles.

It happens that after submitting a declaration through the “Personal Account”, an employee of the organization discovers an error in the information. In this case, you should not wait and hope that it will not be detected by the regulatory authority. You need to submit an application to cancel the submitted declaration and submit a new one with the correct statistical data.
