Responsibility of a customs broker

After concluding a contract for the provision of services, the customs broker acquires the same powers as the owner of the cargo, and from the moment the contract is signed, it is the broker who bears full responsibility to the customer and state customs authorities.

The agreement for the provision of brokerage services includes information about the rights and obligations of the parties, the amount of insurance payments, the form and term of payment, and additional conditions. The powers acquired by a customs broker when signing an agreement with the customer are determined by the requirements of the current legislation and the conditions specified in the agreement.

If the customer violates the terms of the contract, the broker may demand compensation from him for damages within the framework of the provisions of the Civil Code.

If the broker violates the terms of the agreement, sanctions may be applied to him:

  • Administrative penalties
  • Fines
  • Compensation for damage caused to the employer.

For repeated serious violations, the representative company may be excluded from the relevant Register. At the same time, the company is included in the blacklist of customs brokers.

Liability insurance, which is a condition for including a customs broker in the relevant Register, makes it possible to minimize the negative results of work done unprofessionally.

Customs representatives who have been deprived of their license can re-apply for inclusion of the company in the relevant register, but this can only be done after a year has passed from the date of fulfillment of the conditions of the punishment. By the time the re-application is submitted, all deficiencies that gave rise to penalties must be eliminated.

All goods transported across the state border of the EAEU member countries are subject to customs clearance (declaration) at the customs authority. This information can be submitted in paper or electronic form. For legal entities - only electronic. To do this, you need a special program that allows you to exchange information with the government. authority through electronic exchange (filing a declaration of goods (DT) in electronic form). Not every organization is ready:

  • Establish a special customs program and pay annually for renewal
  • Receive a special electronic key - an electronic digital signature (EDS)
  • Hire a specialist on staff - a customs clearance broker who monitors changes in legislation. Therefore, there is only one way to engage a company that specializes in these operations – a customs broker.

What is your export service?

Our task is to make export delivery and processing of exports from Russia as simple and transparent for you as working on the domestic market.

  1. For example, you decided to sell goods to Europe and the question arises, how to export? You choose a buyer and negotiate a price with him. You provide us with the buyer’s contact information and enter into a ruble purchase and sale agreement with us.
  2. We transfer you money (full or partial amount).
  3. After this, all responsibility for the delivery passes to us and we fully undertake customs services for the export of goods. We will conclude an export contract with the end buyer, clear customs and export the goods abroad using proven logistics schemes.
  4. We will transfer the VAT refunded from the budget to you as part of the cost of the goods, so you will receive more money than a foreign buyer will transfer to us in Russia.

The service is very popular among companies starting to export and planning to do export clearance of cargo, as it removes the burden of preparing documents for the tax inspectorate to confirm the zero VAT rate for export. The most popular destinations for exporting goods are Germany, Italy and the USA.

The range of goods we export is extremely rich, a significant part of which consists of forestry products and agricultural cargo.

Customs broker services

The services of a customs broker are absolutely necessary for customs clearance of imports. The most important stage in importing goods to Russia is their customs clearance; without this, the goods cannot be used. To do this, you must provide the necessary documents to the customs office and pay customs duties: tax, excise tax, recycling fee, VAT and duty. Some consider this task to be simple and think that they can easily cope with it on their own. This impression is deceptive; if you do not have knowledge of customs legislation and the necessary experience, you may face significant losses of money and time. In addition, some errors, for example, underestimating customs value, may be regarded as an administrative offense. By using the services of a customs broker, you can avoid troubles and unnecessary costs and losses.

Customs clearance procedure

If a company sends cargo for export for the first time, it is registered in the customs database as a participant in foreign economic activity. To register you must provide:

  • Charter of the enterprise, decision to create the enterprise, constituent agreement.
  • Bank certificates confirming the opening of accounts.
  • OGRN, INN, extract from the Unified State Register of Legal Entities.

Other documents may be added to the main list in some cases provided for by law. For all subsequent export shipments, the registration procedure is no longer required. Necessary actions that are performed when carrying out any export operations:

  • Preparation and submission of a preliminary customs declaration. The document is submitted before the cargo arrives at the customs border.
  • Preparation and submission of a customs declaration directly upon the arrival of the cargo at the customs border.
  • Control by customs authorities over the correctness of documentation, as well as over its compliance with the actual condition and nature of the cargo.
  • Checking the correctness of calculation of the amount of customs value.
  • Monitoring the correct payment of customs duties and other payments.
  • Customs inspection of cargo, its inspection and subsequent provision of status permitting release.

Why is it profitable to cooperate with customs representatives?

Customs brokerage services are relevant for all entrepreneurs who receive goods from abroad for sale, use in production or other purposes. All goods must be declared at customs; the procedure includes collecting a set of documents, filling out a declaration and paying mandatory fees. For legal entities, a mandatory electronic declaration form is provided, therefore, in the absence of an agreement for the provision of customs brokerage services, the entrepreneur is obliged to:

  • buy and install a customs program, pay for its renewal every year;
  • issue and receive a key to an electronic digital signature;
  • hire a customs clearance broker who meets the qualification requirements.

This development of events is absolutely unprofitable for the entrepreneur. He will have to delve into the intricacies of customs legislation and be independently responsible for prompt customs clearance. The presence of a specialist on staff does not provide any guarantee of competent relations with customs authorities. In addition, a permanent employee means inevitable expenses for vacations, sick leave and maternity leave; the employer is forced to adapt to the employee’s personal problems and, if necessary, look for a temporary replacement. And replacing a specialist who turns out to be incompetent is very difficult.

When customs brokerage services are provided by a specialized organization, the entrepreneur receives a lot of advantages:

  1. Pays only for customs clearance services actually rendered. This is especially beneficial if deliveries arrive several times a month. With such frequency, there is no point in paying a full salary to a full-time specialist.
  2. Can choose the employee with whom he is most comfortable communicating. The customs representative is interested in ensuring that customs clearance at the border is carried out as quickly as possible. Only in this case will the client contact them again. A full-time specialist does not have such motivation, since his earnings do not depend on the speed and success of his work.
  3. He doesn’t worry about the specialist getting sick or going on vacation, since all personnel problems are resolved by the management of the representative company.

Taking into account all the above nuances, the services of a customs broker from our company are the most effective and profitable way to ensure that customs procedures are carried out in accordance with the law and one’s own interests.
