Information interaction between customs and government authorities (organizations) of the Member States

In the conditions of integration of the member states of the Eurasian Economic Union (hereinafter referred to as the member states, the Union) when carrying out foreign economic activity (hereinafter referred to as foreign economic activity), the need to improve customs administration increases, including in terms of the implementation by customs authorities of their control functions. One of the most important elements improvement of customs and other types of state control entrusted to customs authorities, it should be noted the organization of interstate information interaction for the purpose of exchanging information (information) and (or) documents between the customs authorities of some member states and the authorized bodies of other member states. The Customs Code of the Union ( hereinafter – the Code) defines the participation of customs authorities in information interaction among themselves, with government bodies, other bodies and organizations of the Member States and the Commission, based on the electronic exchange of documents, for the purpose of information support for customs authorities to carry out the tasks assigned to them. Article 80 of the Code Two directions of information interaction are indicated:​1. Intrastate (between customs authorities and government bodies (organizations) of one member state);2. Interstate (between customs authorities and customs authorities and state authorities (organizations) of different member states).​The implementation of information interaction makes it possible to provide for the possibility for participants in foreign trade activities not to submit to the customs authority the documents necessary to carry out customs operations, if information about such documents and (or ) information from them can be obtained by customs authorities from information systems used by customs authorities, as well as from information systems of state bodies (organizations) of the Member States (clause 2 of Article 80 of the Code). Member States, within the framework of their own programs, implement intrastate information interaction between customs services and government bodies (organizations) of the Member State, the list of which will only increase in the future: in the Republic of Armenia - with 3 authorized bodies (according to 9 documents), in The Republic of Belarus - from the 6th (according to 15 documents), in the Republic of Kazakhstan - from the 15th (according to 42 documents), in the Kyrgyz Republic - from the 7th (according to 12 documents), in the Russian Federation – from 30 (based on 55 documents and information).​

Interstate information interaction is implemented on the basis of Union law using the Integrated Information System of the Union (UIS of the Union). Such information interaction is one of the areas provided for by the Strategy for the Development of Eurasian Economic Integration until 2025. The Commission is carrying out work to organize the receipt by the customs authorities of the Member States of information from 7 most relevant documents (issued in the areas of technical regulation, sanitary and quarantine measures, non-tariff regulation). Interstate information interaction of the customs authority of a member state with government bodies (organizations) of other member states is implemented using the Union’s IIS within the framework of the general process of the Union “Use of Databases” data of documents drawn up by the authorized bodies of the member states of the Eurasian Economic Union, when regulating foreign and mutual trade, including those presented when carrying out customs operations for the purpose of confirming compliance with prohibitions and restrictions”, defined by paragraph 1 of the List of general processes within the framework of the Eurasian Economic Union, approved By decision of the Commission Board of April 14, 2015 No. 29 (hereinafter referred to as general process No. 1).

Compositions of information and procedures for obtaining them during interstate information interaction

The composition of information that can be obtained by customs authorities from the information systems of state bodies (organizations) of the Member States during interstate information interaction, as well as the procedures for obtaining such information, were approved by the Commission as part of the implementation of the provisions of paragraph 4 of Article 80 of the Code in the following acts of the Union:​

Rules for the implementation of interstate information interaction

In accordance with the Procedure for the implementation of general processes within the framework of the Eurasian Economic Union, approved by the Decision of the Commission Board dated December 19, 2021 No. 169, the Decision of the Commission Board dated August 21, 2021 No. 136 “On approval of the Rules for the implementation of the general process “Use of databases of documents drawn up authorized bodies of the member states of the Eurasian Economic Union, when regulating foreign and mutual trade, including those represented during customs operations for the purpose of confirming compliance with prohibitions and restrictions,” approved the Rules for the implementation of the general process No. 1, which define: 1. general universal requirements for implementation general process No. 1; 2. features of the implementation of information interaction within the framework of the implementation of general process No. 1 regarding the receipt by the customs authorities of the Member States of information on issued certificates of conformity and registered declarations of conformity of products with the requirements of the technical regulations of the Union (technical regulations of the Customs Union), issued certificates of conformity and registered declarations of conformity on products included in the unified list of products subject to mandatory confirmation of conformity with the issuance of certificates of conformity and declarations of conformity in a unified form;3. features of the implementation of information interaction within the framework of the implementation of the general process No. 1 regarding the receipt by the customs authorities of the Member States of information on issued certificates of state registration of products confirming the compliance of products with the requirements of the technical regulations of the Eurasian Economic Union (technical regulations of the Customs Union) or the Unified Sanitary-Epidemiological and Hygienic requirements for products (goods) subject to sanitary and epidemiological supervision (control), approved by the Decision of the Customs Union Commission dated May 28, 2010 No. 299 (as amended by the Decision of the Commission Board dated September 10, 2021 No. 149);4. features of the implementation of information interaction within the framework of the implementation of general process No. 1 regarding the receipt by the customs authorities of the Member States of information from licenses for the export and (or) import of certain types of goods (as amended by the Decision of the Board of the Commission dated May 19, 2021 No. 57​). As permitting documents are determined, according to information from which the implementation of interstate information interaction will be required, the Rules for the implementation of general process No. 1 will be supplemented by the Features of the implementation of information interaction within the framework of the implementation of general process No. 1.

Implementation of interstate information interaction

Based on the provisions provided for by the law of the Union on the implementation of information interaction in electronic form, the Commission developed and agreed upon technological documents regulating information interaction in the implementation of general process No. 1 by means of the Union's IIS. Technological documents of general process No. 1 were approved by the Decision of the Board of the Commission dated January 14, 2021. No. 10 “On technological documents regulating information interaction in the implementation of the general process by means of the integrated information system of the Eurasian Economic Union “Use of databases of documents drawn up by the authorized bodies of the member states of the Eurasian Economic Union, when regulating foreign and mutual trade, including those presented when making customs operations for the purpose of confirming compliance with prohibitions and restrictions.”

The timing for participants to join the general process No. 1 is determined by Order of the Commission Board dated January 14, 2021 No. 7 “On the timing of joining the general process “Use of databases of documents prepared by authorized bodies of the member states of the Eurasian Economic Union in regulating foreign and mutual trade, including those submitted during customs operations for the purpose of confirming compliance with prohibitions and restrictions" in terms of receipt by the customs authorities of the Member States of the following information:

on issued certificates of conformity and registered declarations of conformity of products with the requirements of technical regulations of the Eurasian Economic Union (Customs Union), issued certificates of conformity and registered declarations of conformity for products included in the unified list of products subject to mandatory confirmation of conformity with the issuance of certificates of conformity and declarations of conformity according to a single form;

on issued certificates of state registration of products confirming compliance of products with the requirements of technical regulations of the Eurasian Economic Union (Customs Union) or the Unified Sanitary-Epidemiological and Hygienic Requirements for products (goods) subject to sanitary-epidemiological supervision (control), approved by the Decision of the Customs Union Commission dated May 28, 2010 No. 299​.

​The terms for participants to join the general process No. 1 regarding the receipt by the customs authorities of the Member States of information from licenses for export and (or) import of certain types of goods are determined by Order of the Commission Board dated November 9, 2021 No. 183 “On the terms for joining the general process” The use of databases of documents prepared by the authorized bodies of the member states of the Eurasian Economic Union in regulating foreign and mutual trade, including those presented during customs operations for the purpose of confirming compliance with prohibitions and restrictions." Joining participants in the general process No. 1 in terms of receiving customs authorities of the Member States will plan information from licenses for the export and (or) import of certain types of goods as the information systems of the participants are ready, but no later than September 1, 2023.​
