about industrial practice

1.1.Activities of Tyumen customs today.

For the last two years, Tyumen customs has been working under the conditions of the functioning of the Customs Union.

The main economic effect for participants in foreign economic activity was the possibility of unhindered movement of goods within the framework of mutual trade between Russia, Belarus and Kazakhstan. Reducing the financial burden on commercial enterprises, eliminating administrative barriers, and unifying customs procedures and rules have significantly improved business conditions, which in turn has influenced the development of many regions, including the south of the Tyumen region.

In the new conditions, the number of regular participants in foreign trade activities has increased, which means that trust in Tyumen customs has strengthened.

Today, customs activities are aimed at:

  • implementation of control and analytical indicators;
  • improving the quality of customs regulation, helping to create conditions for attracting investment into the Russian economy;
  • improvement of customs administration;
  • strengthening interaction with other government agencies in the fight against terrorism, smuggling of weapons and drugs, and counterfeit products.

Customs carries out targeted, systematic work to create conditions for the development of highly professional human resources capable of fulfilling the tasks set by the Federal Customs Service of the Russian Federation, which they try to fulfill with dignity and quality.

There is a steady increase in the volume of customs declarations and foreign trade turnover.

Tyumen customs carries out active explanatory work with participants in foreign trade activities. More than 100 explanations of the new customs legislation are posted on the official website of the Department of Investment Policy and State Support of Entrepreneurship under the Government of the Tyumen Region for foreign trade participants and business representatives, and over 300 information materials are posted on the media portal of the Government of the Tyumen Region “TyumenMedia”.

In 2013-2014, customs officials took part in 19 large-scale events with representatives of the business community of the Tyumen region, where topical issues of foreign economic activity were discussed.

With the direct and active participation of the Tyumen customs post, many investment projects implemented by the Government of the Tyumen region are being implemented.

1.2. Place and role of the administrative investigation department.

The Administrative Investigation Department (hereinafter referred to as the DIA) is a structural unit of customs that directly initiates cases of administrative offenses within the competence of customs authorities and conducts administrative investigations into them, as well as organizes the activities of structural divisions of customs and subordinate customs posts for administrative proceedings.

The role of the OAR in the structure of Tyumen Customs is to conduct administrative and investigative, preventive, organizational and legal activities aimed at implementing a set of measures to combat offenses within the competence of the customs authorities of the Russian Federation.

Direct management of the activities of the OAR is carried out by the head of customs and the first deputy for law enforcement.

Department head:

1) manages the activities of the AAR on the basis of the principle of unity of command, organizes and controls the work of the AAR;

2) takes part in meetings held by the management of the Ural Operational Customs, customs when considering issues within the competence of the UAR;

3) distributes job responsibilities among officials of the UAR;

4) gives instructions and instructions to officials of the UAR that are binding;

5) plans the activities of the UAR;

6) controls the implementation of activities on issues within the competence of the OAR;

7) analyzes the work of the AAR and prepares reports on its activities;

8) participates in the selection and placement of personnel of the UAR, ensures compliance by officials of the UAR with official discipline;

9) takes measures to ensure the necessary conditions of service for officials of the UAR;

10) makes, in accordance with the established procedure, proposals to the head of customs on sending UAR officials on business trips;

11) endorses draft documents prepared by the OAR, as well as other documents received for approval from other structural divisions of customs;

12) makes, in accordance with the established procedure, proposals for the assignment of special ranks to officials of the UAR, as well as proposals for the application of incentive and disciplinary measures against them;

13) represents the AAR in government bodies, public associations and other organizations;

14) creates conditions for improving the qualifications of UAR officials, contributes to improving the conditions of their service;

15) bears other duties, enjoys other rights and bears responsibility in accordance with the legislation of the Russian Federation.

The activities of the department are based on the work plans of the customs and the department (the work plan of the OAR is coordinated with the Ural operational customs and approved by the deputy head for law enforcement activities), a combination of the principle of unity of command when resolving issues of official activity and the personal responsibility of each official of the department for the state of affairs in the assigned area and for execution of individual orders.

Officials of the Department have the right to freely enter the official premises of customs, subordinate customs posts, and customs control zones and remain there while performing their official duties.

Officials of the Administrative Administrative District, when carrying out administrative proceedings, have all the procedural powers provided for by the Code of Administrative Offenses of Russia.

The staffing level of the department is established within the framework of the customs staffing table, which is approved by order of the customs.

The head of the customs authority is appointed to the position, dismissed from the position, and dismissed from service in the customs authorities by order of the customs office upon the proposal of the deputy head of customs for law enforcement, in agreement with the Ural Operational Customs and UTRD FCS of Russia.

During the absence of the head of the department, the performance of his official duties is assigned to another official of the department, appointed in the prescribed manner by order of the customs office.

Other officials of the department are appointed to positions, dismissed from positions, and dismissed from service in the customs authorities by order of the customs office upon the proposal of the deputy head of customs for law enforcement.

1.3. Tasks and functions of the administrative investigation department.

The OAR solves the tasks assigned to it both directly and in interaction with other structural divisions, customs officials and subordinate customs posts.

Record keeping and measures to ensure secrecy in the Department are carried out in accordance with the established procedure.

When carrying out its activities, the OAR complies with the requirements of legal acts of the Federal Customs Service of Russia on issues of ensuring information security.

Main tasks of the department:

  • Ensuring during administrative proceedings a comprehensive, complete, objective and timely clarification of the circumstances of each case of an administrative offense and its resolution in accordance with the legislation of the Russian Federation, as well as ensuring the execution of the issued decision;
  • Organization and control of administrative proceedings in the structural divisions of customs and at customs posts subordinate to it;
  • Identification of the causes and conditions conducive to the commission of administrative offenses, prevention of administrative offenses;
  • Analysis of statistical data on cases of administrative offenses.

Main functions of the department:

  • Consideration, upon written instructions from the deputy head of customs for law enforcement, of materials received from structural divisions of customs, whose officials are not authorized to draw up protocols on cases of administrative offenses, from law enforcement and other government agencies, local government bodies and public associations, messages and statements of individuals and legal entities, as well as messages in the media containing data indicating the presence of an administrative offense event;
  • Acceptance, on the basis of Part 4 of Article 28.7 of the Code of Administrative Offenses of the Russian Federation (CAO of Russia), by a written decision of the Deputy Head of Customs for Law Enforcement, to proceed with cases of administrative offenses initiated by officials of other structural divisions of customs, to carry out an administrative investigation;
  • Initiation of cases of administrative offenses and conduct of administrative proceedings on them;
  • Identification of signs of crimes during administrative proceedings with the subsequent sending of case materials to the head of the inquiry body to resolve the issue of their consideration in accordance with the procedure provided for by the Criminal Procedure Code of the Russian Federation;
  • Monitoring compliance with the law when bringing persons to administrative responsibility;
  • Execution independently or with the involvement of officials of other structural divisions of customs and subordinate customs posts of requests or instructions from customs authorities to carry out procedural actions in cases of administrative offenses in accordance with the procedure and deadlines provided for by the Code of Administrative Offenses of Russia;
  • Sending decisions on cases of administrative offenses that have entered into legal force to the division of property disposal and execution of decisions of authorized customs authorities;
  • Providing methodological assistance to structural units of customs and customs posts subordinate to it in carrying out administrative proceedings, including when making decisions to terminate administrative proceedings;
  • Preparation, on the basis of petitions from subordinate customs posts, for submission to the head of customs or the deputy head of customs for law enforcement, proposals on the validity and need to extend the terms of the administrative investigation in cases of administrative offenses;
  • Participation in customs inspections in order to evaluate the materials collected by the commission to identify sufficient data in them indicating the event of an administrative offense;
  • Informing other law enforcement agencies about facts of offenses within their competence identified during administrative proceedings or when considering materials received from law enforcement and other government agencies, local government bodies and public associations, messages and statements of individuals and legal entities, as well as messages in the media mass media;
  • Development and implementation of measures to prevent administrative offenses, organization of such work at subordinate customs posts;
  • Ensuring control over the validity and timeliness of the initiation of cases of administrative offenses by structural divisions of customs and subordinate customs posts;
  • Interaction with judicial, law enforcement and other government agencies on issues of identifying, preventing, suppressing administrative offenses and carrying out administrative proceedings;
  • Participation, together with the legal department of customs, in protecting the interests of customs authorities in courts of general jurisdiction and in arbitration courts when considering cases of administrative offenses, as well as in connection with appeals or protests of decisions, decisions in cases of administrative offenses made by customs officials or the court;
  • Preparation of proposals for appealing decisions made by a judge in cases of administrative offenses, administrative proceedings for which were carried out by a customs official, as well as court decisions on a complaint against a decision made by a customs official, a decision in a case of an administrative offense;
  • Participation in the selection and placement of personnel of the Department, as well as in coordinating the appointment and dismissal of deputy heads of customs posts for law enforcement and heads of administrative investigation units of subordinate customs posts;
  • Identification of legal problems arising during administrative proceedings, as well as when courts consider cases of administrative offenses, preparation and submission, in accordance with the established procedure, for consideration by the Deputy Head of Customs and the State Technical Inspectorate of the Federal Customs Service of Russia proposals for their resolution;
  • Preparation and submission to the Deputy Head of Customs for Law Enforcement Activities of analytical reports on the results of the Department’s work and proposals for its improvement for sending, in accordance with the established procedure, to the management of the operational customs and TDRD FCS of Russia;
  • Performing the functions of accounting and registration departments.

To perform the assigned tasks and functions, the department has the right:

  • Submit proposals on issues of their activities for consideration to the head of customs, deputy head of customs for law enforcement;
  • Request and receive from the structural divisions of customs and subordinate customs posts, in accordance with the established procedure, the necessary statistical, analytical and other data, documents, conclusions and other information necessary for making decisions on issues within the competence of the department;
  • Use departmental information systems in accordance with the established procedure and create your own databases;
  • Interact in the prescribed manner with state authorities, local governments, legal entities and individuals on issues within the competence of the department;
  • Submit petitions to extend the terms of the administrative investigation in cases of administrative offenses being processed by the department;
  • Submit for consideration the Deputy Head of Customs for Law Enforcement Activities proposals to conduct official checks against customs officials and subordinate customs posts who have committed violations of the legislation of the Russian Federation in the performance of their official duties, identified during administrative proceedings;

  • Request and receive, in accordance with the Code of Administrative Offenses of Russia, from government bodies, organizations, regardless of form of ownership and subordination, from officials of law enforcement, regulatory and other government bodies, the necessary documents and information.

Use of forensic technology and technical means by the Department:

  • In order to fulfill the tasks assigned to it, the department is provided with the necessary forensic equipment and technical means, including vehicles, office equipment in accordance with the standards established by the Labor Code of the Customs Union.
  • Forensic technology and technical means available in the Department are used exclusively to perform the tasks provided for by these regulations.
  • The Head of the Department assigns forensic equipment and technical means to specific officials of the Department, who use them in accordance with the established procedure.

The Head of the Department is personally responsible for the implementation of the functions assigned to the department, including the implementation, within the competence of the Department, of programs, plans and performance indicators of customs.

Officials of the Department in cases of failure to perform or improper performance of official duties bear responsibility in accordance with the legislation of the Russian Federation.

The assignment to the Department of tasks and functions not provided for in the Regulations on the Administrative Investigation Department of Tyumen Customs, except for special (targeted) instructions from the head of customs, deputy head of customs for law enforcement, is not allowed.

As can be seen from the table above, the detection and suppression of administrative offenses for 7 months of 2014 remains at the level of 2013 in the same period.

Slight negative dynamics in the work to improve the efficiency of identifying administrative offenses was due to a decrease in the number of administrative cases initiated by customs in 2014 for violations of currency legislation (Article 15.25 of the Code of Administrative Offenses of the Russian Federation).

This situation arose as a result of the liquidation of a legal entity on June 28, 2013 (one-day company Lespromservice LLC), which was the subject of cases of administrative offenses initiated by customs in 2013 and the 1st half of 2014 under Art. 15.25 Code of Administrative Offenses of the Russian Federation.

In 2014, Tyumen customs initiated 379 cases of administrative offenses, which is less than the same period in 2013 by 1 offense (2013 - 378 cases of administrative offenses).

2.2. Prospects for the development of the activities of the administrative investigation department.

Increasing the efficiency of activities to identify and suppress administrative offenses is planned in connection with the opening of new flights from the Republic of Tajikistan (Dushanbe) and China (Sanya) from September 28, 2013.

According to the commodity aspect of the offenses, the most common subjects of administrative offense in Tyumen customs were the following goods:

  • tobacco product “nasvay”,
  • products of animal and plant origin (meat, dairy products, spices, seedlings),
  • aircraft spare parts,
  • vehicles.

The situation regarding the subjects of offenses is as follows:

  • In the current period of 2014, 21 AP cases were initiated against legal entities; in 2013 (APPG), the number of AP cases initiated against legal entities was 58, a decrease of 37 cases.

In the period under review in 2014, in accordance with Article 29.13 of the Code of Administrative Offenses of the Russian Federation, 13 submissions were made to eliminate the causes and conditions that contributed to the commission of an administrative offense, while in the same period last year 18 submissions were made.

  • In 2014, 354 cases of accidents were initiated against individuals, which is 35 cases more than the same figure in 2013.

The main subject of the administrative offense in cases of accidents initiated against individuals in 2014 was the goods “nasvay”, products of animal origin, vehicles, and wristwatches.

In 2014, practice was developed in interaction with the traffic police in the Tyumen region in order to identify and suppress offenses for which responsibility is provided for in Art. 16.24 Code of Administrative Offenses of Russia. As of July 1, 2014, 14 cases of accidents have been initiated under Part 2 of Art. 16.24 of the Code of Administrative Offenses of Russia on the facts of the transfer by individuals for the use of temporarily imported vehicles to other persons, 2 checks are also carried out on similar facts based on information received from the Tyumen police departments.

Based on the results of consideration of accident cases, penalties were imposed in the form of an administrative fine (6 cases) and in the form of confiscation of a vehicle (4 cases).
