What electronic signature is needed for customs?

For documents on foreign economic activity (FEA), including customs declarations, Law dated August 3, 2018 N 289-FZ “On Customs Regulation of the Russian Federation” allows the use of only a qualified electronic signature (CES). But even if a legal entity or individual entrepreneur already has it, customs requires a separate one.

To work in the state system of the Federal Customs Service (FCS), an electronic digital signature must meet special requirements:

  • the certificate must be non-exportable.

What documents does customs accept electronically?

An electronic signature can be used not only for declaration. Customs accepts electronically:

  • permits;
  • documents on the placement and storage of goods in temporary storage warehouses;
  • accompanying documentation;
  • transit declarations;
  • preliminary information;
  • statistical form;
  • SEZ reports.

Each declarant who formalizes customs operations in the FCS information systems must have his own electronic signature.

Electronic declaration procedure

Customs clearance of cargo under the client’s digital signature is carried out according to the following algorithm:

  • Preparation of documents and their translation into XML format.
  • The materials are sent to the declarant.

New rules will affect certification centers

Currently, commercial certification centers (CAs) are issuing digital signatures for everyone who needs it, which must undergo re-accreditation by July 1, 2021.

Not all CAs will be able to remain “in service” due to stricter requirements: The minimum amount of CA’s own funds has been increased from 7 million to 1 billion rubles, the amount of CA’s insurance funds has been increased from 30 million to 100 million rubles, accreditation is provided for 3 year, and not for 5 years as before, and if the accreditation of a CA is terminated early, it will be able to receive a new one only after 3 years.

Also, for employees and authorized representatives of the CA, civil, administrative and, in some cases, criminal liability is provided for failure to fulfill the obligations established by the legislation on electronic signatures.

It is important to know whether your usual CA has passed accreditation according to the new requirements. The list of accredited CAs will become available in the second half of 2021 on the Ministry of Digital Development website .

If your CA is re-accredited, the digital signature issued by it can be used until the end of 2021 or the validity period of such digital signature (depending on which event happens first). In the meantime, by January 1, 2022, you will need to slowly obtain a free CEP from the Federal Tax Service Center. This applies to legal entities, entrepreneurs and notaries.

For individuals, an electronic signature issued by a center that has passed re-accreditation will remain valid in 2022 until such electronic signature expires completely.

Registration procedure

When registering goods under the digital signature of a customs representative, all responsibility lies with him. Is there a difference in which certification center to receive the digital signature?

Each customs representative (broker) uses software from different manufacturers to submit declarations to customs authorities. Who is a customs broker/representative?

Customs broker is an outdated common name for companies that carry out customs clearance of the customer’s cargo and represent it in various control and supervision authorities.
Customs representative is a modern, generally accepted term denoting a company that, in addition to customs clearance, provides a wide range of services: assistance in certification of goods, outsourcing of foreign trade activities and other services that are necessary for the import/export of goods.

The Federal Customs Service has its own departmental certification center, however, by virtue of clause 8 of Regulation No. 2187, the departmental CA enters into agreements with third parties (accredited certification centers) who have the right to issue digital signatures on behalf of the departmental CA.

To obtain an electronic signature for electronic interaction with customs authorities, you must:

  1. Select a CA from the list presented on the above website of the departmental certification center.
  2. You can submit an Application, which is required by virtue of clause 13 of Regulation No. 2187. The application form can be submitted.
  3. Fill out the Application and attach the necessary documents to it, which include: constituent document; extract from the Unified State Register of Legal Entities; tax registration certificate; power of attorney (if the Application is filled out by a representative).
  4. Attach a storage medium (flash card) to the Application. If the card is not attached, the key will be issued on a floppy disk, which is not very convenient.
  5. The application, documents, flash card are transferred to the authorized CA, where the Application is certified.
  6. After the digital signature is ready, it is issued to the applicant based on the original Application. The applicant signs in a special journal that the digital signature has been received.

If we take into account the entire above set, then an electronic digital signature for the Federal Customs Service will cost 8 – 12 thousand rubles.

The signature is valid for 12 months, after which it must be reissued . There will be no need to re-make the USB key, so everything will be much cheaper (especially if you previously purchased a perpetual license for CryptoPro, but using this particular software is not necessary). In principle, you can apply for a reissue of your digital signature earlier, but the old key will be deactivated.
