With a light ferry
Now regular ferry service connects the cargo-passenger ferry terminal in the Kaliningrad city of Baltiysk with the port of Ust-Luga. And entrepreneurs who transport goods in this direction have to fill out transit customs declarations. Individuals also face a number of inconveniences when going on a sea voyage in a personal car.
Such difficulties are due to the geographical location of the Kaliningrad region. The Customs Code of the Customs Union (CU) provides for a special procedure for the transportation of goods through the territory of states that are not members of the CU. And the westernmost Russian region is “sandwiched” between two EU countries - Poland and Lithuania.
However, in the case of the Baltiysk-Ust-Luga ferry, customs transit is an unnecessary procedure, Kaliningrad sea carriers are sure.
“The ferry under the flag of the Russian Federation goes from one Russian port to another according to a strict schedule and route,” says Yuri Pyatanov, president of the Association of Maritime Agents and Forwarders in the Kaliningrad Region. — Passengers of the ship do not undergo border and customs control; they can travel with civilian rather than foreign passports. However, transit declarations must be issued for personal belongings and cars of passengers, as well as for cargo, and this, in our opinion, is incorrect and illogical.
To control risks, customs officers only need to carry out random document checks
At the first stage, it is necessary to level out customs procedures in relation to vehicles of individuals, according to members of the Kaliningrad Association of Maritime Agents and Forwarders. On the second, refuse to process transit at the port of Ust-Luga. And finally, at the third stage, the requirement to place cargo traveling by ferry from the Kaliningrad region to another region of Russia under the customs transit procedure should be completely abolished.
“Carriers can always have accompanying documents confirming that the goods were either entirely produced in Russia, or, if the cargo was imported from abroad, that all necessary duties were paid upon import,” Yuri Pyatanov comments on the situation to the RG correspondent. . — We are talking about invoices, certificates, and so on. To control risks, customs officers only need to carry out random document checks. In this case, there is no need to place goods under the customs transit procedure.
The ferry Baltiysk - Ust-Luga transports not only automobile cargo, but also railway containers. Therefore, representatives of the Kaliningrad Railway support the position of sea carriers.
“Interested parties should submit a proposal to the Federal Customs Service of Russia to amend the current legislative and by-laws of the Customs Union and the Russian Federation,” said the head of the KZD, Sergei Kolomeets. “This will make the rail-ferry method of moving goods between the Kaliningrad region and the rest of the Customs Union more attractive.
The problem of ferry traffic was discussed at a recent meeting of the working group on customs regulation in the Kaliningrad region. Representatives of the Federal Customs Service of Russia supported the position of foreign trade participants regarding the simplification of customs procedures, pointing out, however, that it is currently impossible to completely cancel transit. As a solution to the problem, Tatyana Denisova, head of the department of the main department for organizing customs clearance and customs control of the Federal Customs Service of the Russian Federation, proposed developing a temporary simplified technology that would establish the features of customs transit within the framework of current legislation.
“Concerned representatives of the business community should take direct participation in the development of the scheme,” noted Tatyana Denisova.
Representatives of the Kaliningrad amber industry also encountered difficulties when exporting goods. Previously, in order to send their products to “big Russia”, entrepreneurs were required to obtain a certificate from the Kaliningrad Chamber of Commerce and Industry, confirming the status of amber products as a Customs Union product. It sometimes took manufacturers several months to collect all the necessary certificates.
This disservice was rendered to carriers by the free customs zone regime that operates in the Kaliningrad region. Exclave companies, under a special customs mechanism, can import a number of imported goods for consumption in the region without paying customs duties. However, the removal of goods is associated with inconvenience and time costs. On July 23, 2013, a customs experiment was launched in the exclave, within which manufacturers of solar stone products were able to send their goods to the rest of the Customs Union territory in a simplified manner. In relation to raw amber and products made only from amber, customs control is carried out on the basis of accompanying documents and invoices characteristic of normal business transactions. When moving goods using precious metals and amber, documents from the State Assay Office under the Ministry of Finance of the Russian Federation are used.
“The transition to a simplified regime has certainly become a landmark event for the amber industry,” emphasizes Dmitry Chemakin, Minister of Industrial Policy of the Kaliningrad Region. — The experiment showed that the export of amber products without requiring additional documents is real, and that the customs service can successfully work with amber traders in a simplified mode, controlling all risks. At the same time, the time and financial costs of a number of Kaliningrad amber companies have been significantly reduced.
The experiment is based on a special order of the Federal Customs Service of the Russian Federation, which expires in January next year. Recently, the State Duma adopted in the first reading a law simplifying the export of Kaliningrad amber to “greater Russia”, so in the near future the temporary rules will acquire a permanent basis. And the sea carriers of the exclave will have hope that their problem will eventually be resolved at the legislative level.

At a meeting of the working group on customs regulation, the issue of organizing an international forum and exhibition of products containing amber AMBER WORLD, which will be held in Kaliningrad in July 2014, was discussed. The event will bring together processors and manufacturers of amber products from many countries around the world. And forum participants should not have any problems with customs clearance when importing and exporting amber exhibits.
During the exhibition and preparations for the event, the regional government proposed to give the Kaliningrad excise post the competence to carry out customs operations in relation to precious metals and stones. In turn, representatives of the customs authorities reported that the post has sufficient powers for customs clearance of exhibition exhibits under the temporary import procedure.
