What is a certificate in the form ST-1

The ST-1 certificate of origin confirms the origin of the goods and is required to participate in auctions under 44-FZ for the purchase of certain products.
It is placed on a standard form that has a certain kind of protection. Expiration date - until the end of the procurement procedure. At the same time, there are cases when such a document is issued for a period of up to three months, during which its recipient has the right to participate in several purchases (in which there is a need to provide the document). Issue is allowed for a period of one year - for medicines.

The recipient of the certificate is obliged to report the concluded contracts to the Chamber of Commerce and Industry, as well as their validity periods. Foreign-made products are allowed to participate in the tender on equal terms with Russian-made goods under the conditions established by international treaties (Article 14 44-FZ). Such prohibitions and restrictions are established by regulatory legal acts of the Government of the Russian Federation.

IMPORTANT!

From 07/01/2018, if the purchase is subject to prohibitions, restrictions or admission conditions and the application does not contain a document that confirms the origin of the products from the EAEU countries, it is equated to applications in which foreign products are offered for supply.

When to receive

ST-1 is issued only for those goods that are produced or processed in the territory of the state party to the Agreement of 04/15/1994. It is an A4 sheet, its appearance, as well as the rules for filling it out, are regulated by state agreements, drawn up by the Chamber of Commerce and Industry, and information from it is in a special register. If there is a certificate of origin of goods ST-1, then it is partially or completely exempt from customs duties and taxes. Sometimes this document is the only confirmation that the product is made in a certain country, which is very important for participation in government procurement. Only products of domestic production or manufactured in certain countries are allowed to participate in government procurement, and if there is no confirmation of the appropriate origin, they may not be allowed to bid.

ST-1 is needed only to justify where the goods came from so that, based on this, they can pay duties for them. A certificate of origin in the ST-1 form is also issued if the products are exported to one of the states party to the Agreement on the Establishment of a Free Trade Zone (hence the abbreviation: free trade - ST). This agreement was signed on April 15, 1994, and now its participants are Belarus, Armenia, Georgia, Tajikistan, Kazakhstan, Azerbaijan, Kyrgyzstan, Moldova, Russia, Turkmenistan and Uzbekistan. Previously, Ukraine was also included in the list of parties to the Agreement, but on January 1, 2016, the Association Agreement between Ukraine and the EU came into force, and therefore Russia suspended the free trade zone agreement (FTA) with Ukraine.

The ST-1 certificate of origin for government procurement must be provided if it is planned to participate in tenders for the supply of certain types of engineering and radio-electronic products, medical devices and medicines, and furniture. The rules for participation in auctions of foreign goods on an equal basis with Russian-made products are regulated by 44-FZ. This law details the rules and restrictions on such participation.

Certificate forms

Today, there are three forms of certificate of origin: ST-1, form A and general form.

Type of certificateDescription
According to the ST-1 form Required for products shipped to countries of the Commonwealth of Independent States (CIS). And it is regulated by an agreement on the rules for determining the country of origin of goods in the CIS (Concluded in Yalta on November 20, 2009).

The condition for its registration is the delivery of goods by one sender to one recipient.

At the same time, the product must be made or significantly processed in one of the CIS countries.

Origin of Form AIt is mainly used to work with EU countries, as well as the USA and Canada. This document must be completed exclusively in English.
General shape It is obtained for goods exported to countries that are not in the list of other forms of certificates of origin.

It is also issued when it is impossible to unambiguously determine the state of origin.

Products for which customs preferences are provided

Since certificates of origin are most often provided to obtain preferences, you need to familiarize yourself with the goods for which they are provided. When carrying out foreign economic activity between CIS countries, these are goods from one of the following groups:

  • → plant products;
  • → natural resources;
  • → marine, fishing and hunting products;
  • → second raw materials obtained in the production of the main product;
  • → products obtained from the subsoil.

When is a certificate of origin of goods ST-1 required?

It must be provided when participating in the auction:

  • for the purpose of admitting certain types of foreign mechanical engineering products (as indicated in Decree of the Government of the Russian Federation No. 656);
  • for the purchase of certain types of foreign medical products (Government Decree No. 102);
  • when purchasing vital and essential medicines (RF Government Decree No. 1289);
  • for the purpose of admission to participation in the tender for the purchase of certain types of radio-electronic products (enshrined in Government Decree No. 968);
  • to confirm the country of origin of goods in government procurement of furniture products (Resolution No. 1072).

Varieties of forms of this document in Russia

The following forms of certificates of origin are distinguished: A, ST-1, ST-2, a common form for all other countries. The document is filled out on strict reporting forms, and the certification from the Chamber of Commerce and Industry expert indicates the authenticity of the data provided.

The certificate is presented along with the customs declaration and other documents when crossing the state border. If the certificate is damaged or lost, an officially certified copy may be provided.

Form A

The document confirms the release of products on the territory of the Russian Federation and is intended for the export of goods to the territory of the European Union, as well as the USA, Turkey, Canada, and Japan.

A certificate of country of origin is issued in Form A in English. The document contains the following columns:

  • registration number and country of issue;
  • name and address of the supplier;
  • name and address of the person receiving the goods;
  • information about the transportation route and vehicles (if data is available);
  • product description;
  • data on the number of packages and labeling;
  • criterion of origin of goods;
  • product weight/quantity;
  • invoice number and date;
  • certification by an authorized body.

Approximate production time is 3-5 days. The shelf life is 1 year.

Important! Blots and erasures on the document are not allowed. Changes are made by crossing out and entering current data.

To obtain it you must provide a number of documents:

  1. statement;
  2. invoice;
  3. registration data of the exporting country;
  4. foreign trade contract;
  5. Passport products;
  6. quality certificate;
  7. user manual;
  8. documents confirming the release of goods on the territory of the Russian Federation from domestic materials.

ST-1

This certificate serves as confirmation of the origin of the product for export to the CIS countries and allows you to participate in auctions under 44 Federal Laws for the purchase of products.

The shelf life lasts until the end of the procurement procedure. However, in rare cases, it is 3 months or 1 year (medicines).

Issuance is carried out by the Chamber of Commerce and Industry of the Russian Federation or a division on a paid basis in accordance with the established tariffs.

Required when participating in auctions in the following cases:

  1. For the purchase of certain types of foreign medical products (Government Decree No. 102).
  2. Purchase of vital medicines (PP No. 1289).
  3. Confirmation of the country of origin of goods during government procurement of furniture products (PP No. 1072).
  4. Participation in tenders for the purchase of radio-electronic products (PP No. 968).

To receive it, you must contact the Chamber of Commerce and Industry with a corresponding application signed by the head of the organization.

Attach to the application:

  • certificate of state registration and registration or passport of the Russian Federation (for an individual);
  • annual expert certificate (if absent, a license and a document confirming the ability to produce this product).

ST-2

Reference. The document is issued for goods produced on the territory of the Russian Federation and exported to the Republic of Serbia.

Issued and issued for one batch of goods. Valid for 12 months from the date of approval by the Chamber of Commerce and Industry.

Issued in both English and Russian and contains the following information:

  • name of the country of issue and destination;
  • shipper/exporter information;
  • information about the consignee/importer;
  • means of transport and route;
  • number of pieces and type of packaging;
  • description and quantity of goods;
  • origin criterion;
  • invoice number and date;
  • service marks;
  • declaration of the applicant and certificate of the controller with date, signature and seal.

Upon presentation of the certificate at customs, Russian and Serbian goods are exempt from customs duties (free trade regime).

One of the goals of obtaining a certificate in the ST-2 form is to increase the competitiveness of domestically produced products.

General paper

Issued for the export of Russian goods to all countries, with the exception of the CIS. For export to Ukraine, applicable from January 2, 2021.

Filling out takes place in the same language in which the form is printed (Russian, English).

The form contains information:

  • Document Number;
  • name, address, country of exporter and recipient;
  • product description;
  • country of origin;
  • type of transport and route;
  • number of pieces and type of packaging;
  • total weight or other quantity;
  • service notes and additional information;
  • place, date, signature of the certifying person, name and seal of the certifying organization;
  • exporter's declaration.

The certificate is valid for 12 months. Processing time is 1-3 days.

Package of documents required for registration:

  1. statement;
  2. product supply agreement;
  3. packing list;
  4. invoice;
  5. a document confirming the production of goods on the territory of the Russian Federation.

Conditions under which a general certificate is not required:

  • transportation of transit cargo;
  • cargo related to “temporary export”;
  • a batch of products worth less than 20 thousand rubles;
  • products carried by an individual for personal use.

Important! In case of improper execution (corrections, blots, absence of seals/signatures, unreliable data, etc.), the inspection body has the right to request additional information from the institution that issued the document.

How to get

The main document that regulates the issuance procedure is the Regulation on the procedure for registration, certification and issuance of certificates of origin of goods No. 172-14 dated December 23, 2015.

ST-1 can be obtained for certain types of products in accordance with special documents, for example, Order No. 155 dated December 22, 2016 regulates the procedure for obtaining certain types of radio-electronic products, and Chamber of Commerce and Industry Order No. 93 dated December 21, 2015 is provided for medicines.

The document is drawn up on the basis of an initial examination report (performed by Chamber of Commerce and Industry experts), which is valid for one year from the date of preparation.

To obtain the ST-1 certificate, the bidder must apply to the Chamber of Commerce and Industry with an application for issuance, signed by the head of the submitting organization. The application must indicate product data (quantity, name and address of the manufacturer). Other information that the applicant considers necessary to provide may also be indicated.

The following documents are attached to the application:

  • title documents of the recipient (certificate of registration and registration, for an individual - Russian Federation passport);
  • annual certificate of the expert (if available, you must refer to it in the application).

In the absence of an expert report, you must provide:

  • information about the production of products (license);
  • information confirming the possibility of producing this product.

The certificate is issued directly to the applicant by the Chamber of Commerce and Industry (or its division).

Cases of refusal to issue:

  • inconsistency of the set of papers submitted for consideration;
  • payment for services was not made.

05/30/2018 The Chamber of Commerce and Industry issued Order No. 52. In it, the Chamber of Commerce and Industry approved the procedure for issuing examination reports and ST-1 certificates. This Order reveals the norms of Government Resolution No. 719 of July 17, 2015. It is noteworthy that the issued document closed a huge number of questions about the examination protocols of the Chamber of Commerce and Industry and ST-1.

First of all, it must be said that the Order regulates the process of obtaining documents only in the case when the country of origin of the goods is the Russian Federation. General form: all others and no benefits

When importing products to all other countries, a general certificate must be issued.

The filling language is English. They also receive it when they do not need to present other certificates of origin at customs. It is needed when it is necessary to present such a document at customs, but customs benefits when exporting products are not provided.

  • copy of TIN;
  • certificates of the Unified State Register of Legal Entities or Unified State Register of Individual Entrepreneurs;
  • supply agreement or contract between the sender of the product and its recipient;
  • primary, that is, primary documents confirming the upcoming operation (invoice with a product list, invoices, delivery notes, specifications);
  • manufacturer's documents confirming the fact that the product was manufactured in Russia. This is a description of the raw materials from which the product is made, a list of technological operations, cost calculations of components. Extracts from the manufacturer’s technical regulations should be submitted;
  • technical documentation;
  • covering letter. It can be prepared in free form. It must describe the route, the transport on which it is delivered, the type of container, weight;
  • If the goods have already been shipped from the manufacturer, a cargo customs declaration is required.

Validity period and nuances of use

The executed document can be used for no more than one year. When using it, the following rules are observed:

  • → All information on issued certificates of origin is transferred to the central database of the Chamber of Commerce and Industry. If the need arises, you can refer to it and check the validity of a separate document.
  • → The certificate is issued for a consignment of goods, which can enter the customs territory in whole or in parts.   • → If the certificate is lost, you can apply for a duplicate. In this case, its validity period will be similar to that set for the original.

The certificate of origin and the documentation that served as the basis for its receipt must be kept for 3 years.

Documentation required when applying to the Chamber of Commerce and Industry

The entrepreneur will need:

  • → Application for registration.
  • → Registration certificate.
  • → Letter with OKPO code.
  • → Taxpayer Identification Number;
  • → Information and documentation confirming the presence of production facilities at the entity.
  • → Information and documentation on the basis of which it is possible to confirm the fact of production of the goods.
  • → Service station.
  • → Technological maps.
  • → Certificates and declarations of conformity of goods.
  • → Licenses and permits for certain types of work.
  • → For products in the production of which foreign materials were used, their description, unit price calculation, accounting documentation.
  • → Letter of guarantee for concluding a contract subject to an application from an entity that is neither the manufacturer nor the owner of the products.
  • → Other documentation.

Where and how is certification carried out?

In accordance with legislative norms, the right to issue certificates is vested in the Chamber of Commerce and Industry of the Russian Federation, its regional representative offices, as well as special accredited and licensed bodies. The procedure consists of several stages:

  1. Selecting the appropriate territorial service.
  2. Analysis of requirements and collection of a number of documents.
  3. Concluding an agreement with an expert organization - if necessary, providing a document that is a certificate of origin of the goods.
  4. Submitting an application and receiving a certificate.

When registration is not required

  1. Legal requirements become irrelevant in the following situations:
  2. Purchases are for personal use only.
  3. Application of temporary stay or transit procedures to cargo.
