What does “Country of origin of goods” mean?

When making purchases under Law No. 44-FZ, national treatment is applied to goods originating from a foreign state or a group of foreign states, works and services respectively performed and provided by foreign persons, except for the cases specified in Part 7 of Article 14 of this Law. Within the framework of the national regime, prohibitions, restrictions and conditions for the admission of foreign goods are established. Therefore, when participating in procurement with national treatment, it is important to correctly confirm the country of origin of the goods proposed for delivery.

This term refers to the state where a particular product was produced or substantially processed. The person supplying goods or performing work or services within the framework of this delivery is required to indicate the country of origin.

Certificate of origin - what is this document?

It is known that an integral condition for the import or export of industrial goods across the state borders of sovereign countries is mandatory payments for the movement of goods across the border - customs duties.

The amount of money collected depends, among other things, on the country of origin of the exported/imported products.

The “country of origin” means the state in whose territory the product was produced entirely or received the most significant processing, which determined its final characteristics and the HS code.

Depending on the country of origin of the goods, customs duties may be:

  • General (or general) – maximum, the same for all countries
  • Minimum - established according to the most favored nation treatment in trade, within the framework of mutually beneficial cooperation
  • Preferential - set below the minimum level, up to the complete abolition of customs duties

An official document confirming the country of origin of industrial products transported through the customs zone is called a certificate of origin.

What is the CT-1 certificate

The supplier is required to provide a ST-1 certificate when moving products across the borders of CIS countries or when participating in competitive procurement. The article discusses the use of the certificate in the field of public procurement. This document is drawn up in a specific form on a secure form.

It states:

  1. shipper or exporter;
  2. consignee or importer;
  3. means of transport and route;
  4. certificate number and name of the country in which it was issued;
  5. purpose of creation and validity period;
  6. serial number of the position;
  7. number of pieces and type of packaging;
  8. product description;
  9. passing criteria;
  10. quantity of goods;
  11. invoice number and date;
  12. certification certificate;
  13. applicant's declaration.

The validity period of the certificate depends on the planned participation in the auction:

  • for the duration of participation in one government procurement - if the supplier participates in one tender;
  • three months - to participate in several auctions;
  • one year - for medicines.

Russian origin is required during competitive procurement of certain types of goods:

  • medical products;
  • vital medications;
  • some radio electronics products;
  • certain types of industrial goods

How to get

The main document that regulates the issuance procedure is the Regulation on the procedure for registration, certification and issuance of certificates of origin of goods No. 172-14 dated December 23, 2015.

ST-1 can be obtained for certain types of products in accordance with special documents, for example, Order No. 155 dated December 22, 2016 regulates the procedure for obtaining certain types of radio-electronic products, and Chamber of Commerce and Industry Order No. 93 dated December 21, 2015 is provided for medicines.

The document is drawn up on the basis of an initial examination report (performed by Chamber of Commerce and Industry experts), which is valid for one year from the date of preparation.

To obtain the ST-1 certificate, the bidder must apply to the Chamber of Commerce and Industry with an application for issuance, signed by the head of the submitting organization. The application must indicate product data (quantity, name and address of the manufacturer). Other information that the applicant considers necessary to provide may also be indicated.

The following documents are attached to the application:

  • title documents of the recipient (certificate of registration and registration, for an individual - Russian Federation passport);
  • annual certificate of the expert (if available, you must refer to it in the application).

In the absence of an expert report, you must provide:

  • information about the production of products (license);
  • information confirming the possibility of producing this product.

The certificate is issued directly to the applicant by the Chamber of Commerce and Industry (or its division).

Cases of refusal to issue:

  • inconsistency of the set of papers submitted for consideration;
  • payment for services was not made.

05/30/2018 The Chamber of Commerce and Industry issued Order No. 52. In it, the Chamber of Commerce and Industry approved the procedure for issuing examination reports and ST-1 certificates. This Order reveals the norms of Government Resolution No. 719 of July 17, 2015. It is noteworthy that the issued document closed a huge number of questions about the examination protocols of the Chamber of Commerce and Industry and ST-1.

First of all, it must be said that the Order regulates the process of obtaining documents only in the case when the country of origin of the goods is the Russian Federation. Accordingly, it will be useful to customers when it is necessary to check the correctness of filling out ST-1 and the examination report. This directly affects the provision of preferences, as well as the application of other national treatment measures. What is needed to obtain ST-1

The certificate is issued by the Chamber of Commerce and Industry of the Russian Federation on a paid basis. You can select a suitable regional office on the department’s website. The document can be drawn up by the product manufacturer or supplier. It is necessary to submit an application to the Chamber of Commerce and Industry and prepare a package of documents in the form of copies with a seal, namely:

  • constituent documents of the organization;
  • product passport, quality certificate and instructions;
  • a list of each component of the product and their country of origin;
  • incoming and outgoing invoices, waybills;
  • documents confirming Russian production;
  • for suppliers - a letter of guarantee confirming the obligation to purchase this product from the manufacturer.

Registration of the certificate takes up to five days. During this time, Chamber of Commerce and Industry employees carry out an examination of the product’s compliance with the specified requirements. Based on the primary act, a decision on extradition is made.

Application may be refused if:

  • not all documents have been provided;
  • the applicant did not pay the state fee;
  • The declared place of origin of the goods does not correspond to reality.

Copies of documents confirming the issuance of the certificate are entered into the Chamber of Commerce and Industry database and stored for three years. Anyone can access the information using the department’s special service. To verify authenticity, simply enter the certificate number, form and date of issue.

Certificate form A for export

This method of confirming the origin of goods is relevant when transporting them outside the territory of Russia for sale. You can view the list of goods subject to registration on the Chamber of Commerce and Industry website. A certificate of origin of goods, form A, is issued if they are transported to Europe (EU states, Czech Republic, Turkey, etc.), America or Canada. This document not only contains information about goods being exported and allows for lower tax rates, but also introduces quotas on the quantity of certain goods. What happens if you ignore the requirements to provide supporting documents?

A supplier may miss national treatment requirements due to negligence or lack of knowledge in this area.

Further decisions are made based on the procurement rules in which the contractor participates:

  • if there is a ban on foreign goods in the procurement, the application is rejected;
  • If the auction gives preference to Russian-made goods, then a contract is concluded with the supplier, the amount of which is 15% less than the initial price. In other competitive procurements, the customer does not receive a reduction factor to the price when evaluating the application;
  • a foreign product is considered if, in addition to it, only one application from an organization with domestic products is submitted in the auction. If a third supplier appears with Russian goods, the application with an unconfirmed country of manufacture is rejected.

Certificate of Origin Forms

  • Certificate of origin form ST-1: issued when importing into Russia products originating from the CIS countries and for goods manufactured in Russia exported to the CIS countries, North Ossetia and Abkhazia in order to obtain customs preferences under the free trade regime.   • General form certificate of origin (nationwide): provided for the export of Russian goods to countries that do not require other forms of certificates of origin or for the import of Russian goods into CIS countries without receiving customs benefits, for example, to Ukraine.

Rejection of an application with a foreign product

If the tender includes a complete ban on the purchase of foreign goods, the application will be rejected. If there is a price preference for a Russian product, then everything depends on the share of the specified one. If the auction provides for a complete ban on the purchase of foreign goods, the application will be rejected. If the customer sets access restrictions, they are applied according to the “third wheel” principle. If at least two applications are received from different manufacturers, in which the goods are manufactured in the territory of the Russian Federation or the EAEU, and the application contains an ST-1 certificate, the customer rejects all other applications. If there are no two applications that meet such requirements, then the customer does not reject anyone, and the admission conditions established by Order of the Ministry of Finance of Russia dated June 4, 2018 No. 126n are applied to the participants.
