Smolyanin filed a lawsuit against the Smolensk Customs to declare the order to dismiss him from the state civil service illegal.

The order was issued on the basis of clause 8.2 of part 1 of article 37 of the Federal Law of July 27, 2004 No. 79-FZ “On the State Civil Service of the Russian Federation”; his reinstatement in the state civil service from October 29, 2021.

The court did not find grounds to satisfy the demands for recovery from the defendant of payment for the time of forced absence from the date of dismissal to the day of his reinstatement in the service, since the amount of severance pay paid to the plaintiff, subject to offset, exceeds the plaintiff’s average earnings.
