Saidov Ildar Muratovich is a graduate of the Odessa Higher Artillery Command School named after Frunze and the Russian Customs Academy. He worked in customs authorities since 1995: until 2010 - in the Tatarstan customs, in 2011-2014 - head of the customs post Seaport Kavkaz of the Krasnodar customs, in 2014-2015 - first deputy head of the Krasnodar customs, in 2015-2017 - first deputy head of the Southern operational customs. The Basmanny Court of Moscow decided to arrest the head of the Astrakhan customs of the Southern Customs Directorate of the Federal Customs Service of Russia, Ildar Saidov, suspected of exceeding his official powers, resulting in grave consequences (clause “c” of Part 3 of Article 286 of the Criminal Code of the Russian Federation). As the press service of the court reported, the investigation requested a preventive measure in the form of detention, Mr. Saidov was placed in custody until May 12.

As Kommersant wrote, Ildar Saidov (who took over the post of head of Astrakhan customs in June 2021) was detained on March 15 by employees of the central apparatus of the Investigative Committee of Russia (ICR) together with the FSB of Russia, and then transferred to Moscow to conduct investigative actions. Today, March 16, he was charged.

The Investigative Committee reported that in August 2021, the Sovetsky District Court of Astrakhan considered a case of an administrative offense in connection with non-compliance with the customs procedure of Alliance Shipping Ship Repair Enterprise LLC, within the framework of which the sea cargo ship Genrikh Gasanov was seized. .

According to investigators, despite interim measures, Ildar Saidov, exceeding his official authority, gave a written order for the ship to depart from Russia to Iran.

“His illegal actions made it impossible to collect the fine imposed by the court in the amount of more than 83 million rubles. and a significant violation of the procedure established by law for the activities of units of the Federal Customs Service of Russia,” the Investigative Committee noted.

As Kommersant found out, JV Alliance Shipping LLC declared the dry cargo ship Sea Cargo Vessel Durso, manufactured in 1993, for processing (a customs procedure that is used for importing foreign goods into the territory of the Eurasian Economic Union to perform a number of actions ( for example, repairs) and return export) in June 2021. In September 2021, the vessel was registered in the Russian International Register of Ships of the seaport of Taganrog under the name "Genrikh Gasanov". The owner of the ship is PJSC Transfin-M, which leased it to Transmorphlot LLC. JV Alliance Shipping LLC was supposed to repair the ship.

In the summer of 2021, Astrakhan customs, during a desk inspection, found out that repair work was being carried out on the dry cargo ship by two Sokar LLC and four individual entrepreneurs.

All of them were not included in the list of processing organizations, which is a violation.

On November 23, 2021, the customs authority issued a ruling to initiate an administrative case against JV Alliance-Shipping LLC under Part 2 of Art. 16.9 of the Code of Administrative Offenses of the Russian Federation (“Use or disposal of goods in violation of customs procedures”). A week later, the ship “Genrikh Hasanov” was seized, indicating in the arrest protocol that it would be transferred to safekeeping and that the disposal of this vessel would be prohibited.

By a resolution of the Sovetsky District Court of Astrakhan dated July 19, 2019, JV Alliance-Shipping LLC was imposed a fine of half the cost of the goods that are the subject of an administrative offense, 83.14 million rubles. without confiscation of the subject of the administrative offense.

Transmorflot LLC tried to appeal the decision to arrest the vessel in the arbitration court.

The company referred to the fact that Alliance Shipping JV is not the owner of the dry cargo ship, which means it cannot be the subject of an offense.

In March 2021, the court of first instance agreed with the plaintiff’s arguments, declared the arrest of “Genrikh Hasanov” illegal and returned it to the owner, but in July 2021 the appeal overturned the decision, and in November 2019 the cassation court agreed with the appellate court.

As the ICR clarified, the decision to release the ship to Iran was made during the consideration of the administrative case in the Sovetsky District Court (from April to November 2021); the ICR did not provide a more precise date.

Director of JV Alliance-Shipping LLC Mehdi Sharifov told Kommersant that the shipowner actually entered into an agreement with the company for customs processing of the vessel, but the company did not carry out repair work on it. “We didn’t work on this ship, I didn’t see it, we didn’t receive a penny for it, but we were held accountable: we allegedly started work without permission. In fact, I think the shipowners forged my signatures to get the job started. I said at the trial that the documents were not my signatures, but this was not taken into account, the process had already begun and we were found guilty,” Mehdi Sharifov noted. According to him, because of the fine, the ship repair company had to dismiss its employees and declare bankruptcy.
