This heading covers:
Ordinary lorries and vans (open, covered, covered, etc.); cars and vans of all types for delivering goods to your home, vans for moving from apartment to apartment; trucks with automatic unloading devices (tipping trucks, etc.); tank vehicles (whether they are equipped with pumps or not); refrigerated or insulated trucks; multi-deck trucks for transporting acid in impact-proof containers, butane cylinders, etc.; heavy trucks with tilting frames and submersible ramps for transporting tanks, lifting or trenching machines, electrical transformers, etc.; trucks specially designed for the transport of fresh concrete, excluding concrete mixers of heading 8705; waste collectors, regardless of whether they are equipped with loading, compacting, damping and other devices or not.
The inclusion of certain motor vehicles in this heading is determined by certain characteristics which indicate that the vehicles are primarily intended for the transport of goods rather than the transport of persons (heading 87.03). These characteristics are applicable to the classification of motor vehicles which normally have a gross vehicle weight of less than 5 tonnes and which have either a separate enclosed rear area or an open rear platform normally used for the carriage of goods, but may have bench-type rear seats which do not have seat belts. or passenger amenities and which fold along the sides to allow full use of the rear platform for the carriage of cargo. This category typically includes vehicles known as "multi-purpose" vehicles (eg, van-type vehicles, some sport utility vehicles, some pickup trucks). The following features are characteristic features of the design commonly found in vehicles falling under this heading: (a) The presence of bench-type seating that does not have safety devices (for example, seat belts or seat belt anchorages and fittings) or passenger amenities in the rear area located behind the area for the driver and front passengers. These seats are usually foldable or extendable to allow the entire rear floor (van-type vehicles) or a separate platform (pick-up trucks) to be used for cargo transportation; (b) Availability of a separate cabin for the driver and passengers and a separate open platform with side sides and a lowered tailgate (pickup vehicles); (c) Lack of windows in two side panels of the rear body; having a sliding, outward-opening or lift-up door or doors, without windows, on the sides or rear for loading or unloading goods (van-type vehicles). (d) The presence of a permanent panel or partition between the driver and front passenger area and the rear area; (e) Absence of external features of comfort and interior furnishings and fittings in the cargo compartment area which characterize the passenger compartments of vehicles (for example, floor coverings, ventilation, interior lighting, ashtrays). This heading also includes:
(1) Dump trucks, i.e. vehicles of durable construction with a tilting body or a bottom that opens downward, designed for the transport of soil, rock or other materials. These vehicles, which may have a rigid or articulated chassis, are typically equipped with off-road wheels and can be driven on soft ground. This heading includes both heavy and light dump trucks; the latter are sometimes characterized by the presence of a two-position seat, two seats facing opposite directions, or two steering wheels, so that these vehicles can be controlled by a driver who faces towards the body during unloading.
(2) Shuttle trolleys. They are used in mines to transport coal or ore from cleaning machines to conveyors. They are heavy vehicles with low suspension, equipped with tires and having internal combustion engines or electric motors; are unloaded automatically by a conveyor that forms the bottom of the vehicle.
(3) Self-loading vehicles equipped with winches, lifting devices, etc., but intended primarily for transport purposes.
(4) Road-rail trucks, specially equipped for travel on both highways and rails. These vehicles, the road wheels of which rest on railway rails, have carriage-type devices at the front and rear which can be lifted by means of a jack so that the vehicle can move on the road.
Automobile chassis equipped with an engine and a cab also belong to this item.

(b) Load carriers used in mines (heading 84.29).

Explanations for subheadings
Subheadings 8704 10
Typically, these dump trucks can be distinguished from other cargo transport vehicles (particularly tipper trucks) by the following parameters:
— the dump truck body is made of very durable steel sheet; its front part is extended above the driver's cabin to protect the cabin; the entire bottom or part of it is inclined downward and backward;
- in some cases, the driver’s cabin is only half the width of the car;
— no soft axle suspension;
— powerful brakes;
— limited speed and limited area of application;
— special tires for earth-moving machines;
— thanks to the robust design, the ratio of tare weight to payload does not exceed 1: 1.6;
— the body can be heated by exhaust gases to prevent the transported material from sticking or hardening.
It should be noted, however, that some types of dump trucks are specifically designed for use in mines or tunnels, such as those that have a bottom that opens downwards. They differ in some of the features mentioned above; but they do not have a cab or extended protective body part.

The gross vehicle weight is the road weight stated in the technical specifications as the maximum rated weight of the vehicle. This includes the weight of the vehicle, cargo, driver and full fuel tank.

This heading covers four-wheeled all-terrain vehicles having a diesel engine and a control cabin at the front. The rear part has a two-wheel chassis, without equipment, but can be equipped with various equipment.
The heading does not, however, cover vehicles equipped with agricultural and other special equipment (heading 87.05).

1. These subheadings cover vehicles equipped with a forward or backward tilting body or a body having a cutout in the bottom for dropping loads and designed specifically for the transport of sand, gravel, soil, stones, etc. The vehicles classified in these subheadings are intended for use in quarries, mines or construction sites, road construction, airports and ports. Examples illustrating the different types of dump trucks are given at the end of this explanation.
2. These subheadings also cover smaller vehicles that are used on construction sites for transporting soil, crushed stone, cement and concrete mortar, etc. These dump trucks can have a fixed or articulated chassis and can be equipped with two or four wheel drive. Their body can be located above one of the bridges, and the driver’s seat - above the other bridge. The driver's seat is usually located outside the cab.
