In order to improve the structure of customs authorities and implement paragraph 9 of the action plan (“road map”) for reforming the system of customs authorities in the period from 2021 to 2020, approved by order of the Ministry of Finance of Russia dated January 9, 2021 No. 2, in accordance with Articles 10 , 14 Federal Law dated November 27, 2010 No. 311-FZ “On customs regulation in the Russian Federation” (Collected Legislation of the Russian Federation, 2010, No. 48, Art. 6252), orders of the Federal Customs Service of Russia dated March 25, 2014 No. 527 “ On approval of the Procedure for determining or changing the location of the customs authority" and dated September 26, 2011. No. 1939 “On approval of the Instructions on the procedure for maintaining the Classifier of customs authorities and their structural divisions” I order:
1. Create the Ural Electronic Customs from July 10, 2021, subordinating it to the Ural Customs Administration.
2. Approve for the period from July 10 to August 9, 2021 the staffing table (temporary) of the Ural Electronic Customs (appendix).
3. Determine from July 10, 2021 the location of the Ural Electronic Customs at the address: 620075, Sverdlovsk region, Ekaterinburg, st. Gogolya, 27.
4. From July 10, 2021, determine the Russian Federation as the region of activity of the Ural Electronic Customs.
5. Assign the code to the Ural Electronic Customs - 10511000 - from July 10, 2021.
6. 1. The Ural Customs Administration (M.V. Chmora) shall provide:
^state registration of the Ural electronic customs and
submission by August 31, 2021 to the Federal Customs Service of Russia of a copy of a document confirming the fact of making an entry about the Ural Electronic Customs in the Unified State Register of Legal Entities;
2) carrying out activities stipulated by paragraph 1 of this order, within the limits of staffing levels, the wage fund for officials and employees and the limits of budget obligations for 2018, communicated to the Ural Customs Administration;
3) approval by the head of the Ural Electronic Customs and entry into force on August 10, 2021 of the staffing table of the Ural Electronic Customs;
4) submission in the prescribed manner to the Main Financial and Economic Directorate of the Federal Customs Service of Russia of information for the formation of an application for inclusion of the Ural Electronic Customs in the register of participants in the budget process, as well as legal entities that are not participants in the budget process, in accordance with the order of the Ministry of Finance of Russia dated December 23, 2014 No. 163n “On the Procedure for forming and maintaining a register of participants in the budget process, as well as legal entities that are not participants in the budget process” (registered by the Ministry of Justice of Russia on 02/09/2015, registration No. 35954).
1. The Main Financial and Economic Directorate of the Federal Customs Service of Russia (Yu.O. Vakhnyak) shall ensure the introduction of changes stipulated by this order to the orders of the Federal Customs Service of Russia:

1. The Main Organizational and Inspectorate Directorate of the Federal Customs Service of Russia (I.A. “This is one of the goals of reforming the customs system - to make document processing simpler and more convenient for business and reliable for the state,” Vladimir Bulavin, head of the Federal Customs Service of Russia, told an RG correspondent at the opening of the customs office.
The transformation of customs authorities in the country and the transfer of clearance procedures to digital format began in 2021. And the first pilot project started in Yekaterinburg. The choice is not accidental: although the Ural customs post is not the largest in terms of volume, the lion’s share of it is export, and goods from large industrial enterprises. Almost 80 percent are metals and products made from them. More than 8 percent are machines, equipment, vehicles (every second product from this category crossing the border is aircraft or spacecraft). Naturally, with such a scale, foreign partners are interested in ensuring that deliveries are carried out without customs delays.

According to the press service of the Ural Customs, the launch of the electronic format for the year has reduced the time for registering declarations for goods when exporting products from 23 to 4 minutes, and when importing - from 38 to 10. The Ural Electronic Customs issues 900 declarations per day. Higher speed means more income for the treasury: over the past year, UET transferred 66 billion rubles to the federal budget.
The geographic location of the Urals - in the center of Russia - also plays into the hands of digital: electronic declarations can be completed from any corner of the country. And while, for example, the working day has not yet begun in the European part of Russia, operations can be carried out through Yekaterinburg.
Until now, one thing has hampered the development of the process in the Urals: there was not enough space. Electronic customs actually huddled in several offices. Now she has been allocated seven floors in a specially purchased and converted building. All equipment is brand new.
The system also provides autonomous operation in case of an emergency. “Everything is fast, high-quality and, most importantly, objective,” customs officers emphasize. — The temptation of corruption has been virtually eliminated. Because the decision is made by information systems.”
The offices are equipped in an open space style, that is, the workplace of each employee is open - you can see what the computer monitors are showing. And even cell phones, all from the same temptation, are handed over to employees in a special closed iron box during work.
It is curious that in addition to the official opening ceremony with high officials, a guard of honor and the traditional cutting of the ribbon, the customs officers themselves performed their “home” ritual. An electronic cat named Declaration was launched into the main workroom. The cute robot Declaration first meowed loudly, and then actively walked forward under the camera flashes.
Despite the solemnity of the moment, work was already in full swing at the electronic customs post.
“The customs declaration procedure for titanium cargo is currently underway,” Chief State Customs Inspector Dmitry Alekseev explained to me what was happening on the computer monitor.
The people are mostly young, because the digital document processing algorithm itself is new, so they hire employees who have undergone special training.
“We can say that we have taught our information systems not only to write, read, accumulate and process data, but have also come close to the point that they make legally significant decisions,” Vladimir Bulavin emphasized the importance of digital changes.
According to the head of the department, this year the first stage of reforming the system will be completed - 16 electronic control centers will operate across the country instead of almost 700 customs centers that existed in Russia before the start of the reforms.
In 2021 alone, four electronic customs offices will open - in Moscow, St. Petersburg, Rostov-on-Don and in one of the cities in the Far East.
The new Strategy 2030, which has already been presented to the government of the Russian Federation, business, and the international community, provides for further digitalization of the customs scheme, up to the creation of an intelligent checkpoint.

By 2021, 12 electronic declaration institutions were already operating in Russia: in Yekaterinburg, Nizhny Novgorod, Mineralnye Vody and Krasnoyarsk - electronic customs, electronic declaration centers were opened in Kaliningrad, Novosibirsk, Vladivostok, in the Moscow regional and excise customs, customs posts (CED) Baltic and aviation (in Sheremetyevo), also in the Central Energy Customs. — This is a much more manageable and simpler scheme: the location of 400 entry points across the country needs to be controlled by only 16. To make it easy for business to digest this system, customs posts remained in place, but were designed to work with cargo. That is, structural changes did not require changes in logistics.

The only document that we need on paper in the original and which we cannot obtain in any other way is a certificate of origin of the goods. Because it is issued by the country where the product was produced. It is impossible to establish electronic interaction with many countries. The amount of customs duties and VAT depends on the country of origin. Here the declarant may be tempted to cheat - send something unknown electronically, and the need for verification arises. That’s when you need to put your feet up, go and submit the original so that we can verify it. But this reconciliation can be carried out at the post where the cargo is located.

— In 2021, a pilot project was launched in three customs departments - Ural, Volga and North Caucasus, which are less critical in terms of the number of customs posts and cargo volumes. In October, the Ural electronic customs began operating. Are there problems with technology or staff?
— By the end of the year, the Ural electronic customs office will be 75% staffed. In the first months of next year we need to recruit the necessary staff. Almost half of the employees who work now came from Yekaterinburg and Koltsovo customs. The work is intense, but not critical. In the first two weeks, the release time for goods increased, but now they are lower than before: we release imports in 1 hour 50 minutes, and exports in 39 minutes.
The new code, in force this year, consolidates a fundamentally different approach. Previously, a person made a decision about a product, regardless of what kind of electronic assistants there were. Now the decision-making ability is given to the information system: the machine receives the declaration, processes it, and assesses the risks. According to the Ural Department, 43% of export declarations and 20% of import declarations passed through the automatic release of declarations. This is the trend of the future in customs control. That is, process automation. The machine does not have any subjective preferences and corrupt thoughts...
— Let's focus on corruption and personnel. Customs has an Anti-Corruption Service. What has she found in the last three years? How many personnel decisions were made at the request of security officers?
—— The elements of a criminal offense are something that can be brought to court and the judge will decide: here is a fact, here is an event, here is a bribe-giver, here is material evidence, here is a cause-and-effect relationship between all of this. What did he take for, what did he do in return for this money. There are situations when there is little evidence, but we understand that the person has discredited himself and is doing bad things. We try to get such people fired and get rid of them. You just need to clean the system.
— So how many dismissals do you have for negative reasons? And are there any statements about the initiation of a criminal case?
— Just the other day, petty bribery was discovered at the Yekaterinburg customs office - receiving 15 thousand rubles. The amount matters only for qualifying the case, but the official was fired in fact. I cannot say how many people were fired for corruption reasons, because we do not always part with employees with exactly this official wording...
— Recently, the head of the Yekaterinburg customs was fired “for corruption.” The official statement said that the problem was related to the indication of false information about income and property.” But it is obvious that in Yagovitin’s story the problem is not the declaration. The man was not allowed to work for four months until retirement. If there had been a problem with the declaration, he would have been reprimanded, given a disciplinary sanction, he would have gone on leave and resigned and retired...
“I can’t name any other reasons.” I can say that I don't even know them. The Anti-Corruption Service reports directly to Moscow in terms of setting operational operational tasks. For her, I am the same controlled person as all other customs officers. This verification of information about income and property was carried out by the Federal Customs Service, and not by the department. Your assumptions may be valid, but this review was initiated to evaluate the inconsistencies and conclude that the person should be fired.
— And what about the deputy head of the Yekaterinburg customs Vitaly Krylov, who also recently received an offer to write a statement? Why?
—Where did you get this information? .. Vitaly Anatolyevich decided to end his service in the customs authorities and this decision was satisfied by the management.
— At Koltsovskaya Customs, starting in 2021, we have had a complete change in the leadership team... Where will you get personnel for whom there will be no questions?
— It’s difficult with personnel. We will use the principle of rotation and consider regions first.

— The decision on appointment to this position is made by the head of the Federal Customs Service. At this stage, I consider the performance of duties as a test of practice. This, one might say, is an assessment of the sufficiency of professional competencies in the new environment. If it shows its effectiveness, we will definitely petition for his appointment.
There are three candidates for the position of first deputy. Definitely everyone will go through a polygraph. At Koltsovo Customs, the position of first deputy is also not occupied, and a candidate is also being considered. We will use not only the Ural region.
— In the file of the arbitration court, there have become noticeably more disputes related to challenging additional charges of customs value: “UZGA”, “Ural Airlines”... It is noticeable that the customs authorities are massively revising the value, which they themselves approved in 2015-2016. Does this mean that there is a team to change the encoding in order to replenish the budget as much as possible?
- No, the task of replenishing the budget through some tricks was never at all. In 2021, an order was issued to thoroughly control customs values. The principle of its determination has many insufficiently formalized factors that are used by participants in foreign economic activity. How does the inspector determine the customs value? He opens the database, finds the corresponding article and, among all supplies of a similar article, determines the lowest cost. If the price is stated lower, then he can make an adjustment only based on the lowest price indicator.
For example, we have one foreign trade participant who constantly declares goods at $0.5 per kilogram. And we are constantly adjusting it to $3 - that is, 6 times. And he does not sue, does not ask any questions, while his original documents are complete and do not give grounds for suspicion. Let's find out why this happens. There are simply manufacturers of goods, and there is a company that ships them. This company takes the goods from the manufacturer at a real price, consolidates the shipment, prepares new documents and acts as a sender. The contract was concluded between the Russian company and the consolidator.
— That is, he deliberately declares the price obviously lower in order to get the lowest price in the end?
- Yes, and he doesn’t have to strain himself, customs will work for him. And he will always operate at a lower price compared to competitors. That's why he never sues.
But if the corresponding articles are not selected or there are none at all, you need to look for something homogeneous and similar. And the courts do not always have an unambiguous attitude towards these examples.
— Who bears the burden of proof?
- On us. All the court decisions that we lost stated: The customs authority did not prove that the value stated in the documents and declarations is unreliable. We used to lose a lot, often at procedural points. What have we done? We conducted training and improved the training of inspectors. We have introduced priorities in which, first of all, it is necessary to comply with all regulatory formalities in the qualitative assessment and recording of decisions. And judicial practice began to change. If we are losing something now, then in most cases this relates to decisions of past periods. All cases of the current period have a positive judicial perspective.

— In statistics for 9 months, in my opinion, UTU records deductions of 110%. Is it true that in this figure only 40% are current payments, and the rest is the result of adjustments to the customs value and additional charges for previous periods?
- No, of course, this cannot be. Additional charges from customs value adjustments are 1% of the total amount of payments.
— Do you think process automation will solve this problem? When everything is done only by a machine, it will not happen that two years after the delivery of goods you will come, open warehouses, look under the covers and say: “Guys, we have doubts.”
- We definitely will. And we will definitely retain analytics, operational support and “manual” control. No one is immune from scams and falsifications. This is like the situation with clothing from luxury brands, which were declared as threads and fabrics... The risk did not work, the goods did not go through inspection and Christian Dior left the warehouse. And if suddenly the risk works, the inspector issues a notice to the declarant about the need for inspection. When he arrives at the warehouse, threads and fabrics are actually presented for inspection. Someone just changed the tags on the cargo items. The cargo is released, and the information system records the integrity of the participant...
— Who changed the tags?
— An affiliated temporary storage warehouse, its employees, possibly loaders... How can an information system detect such blatant fraud? No way. Therefore, with a desk or field inspection, we will then knock on the door: “guys, we need to check you in three years.”
— There were two temporary storage warehouses in Koltsovo, but one stopped working...
— They simply took measures to make it impossible to re-stick tags in the second warehouse and all its economic efficiency ended. Apparently, it was based only on re-sticking tags, and this gave profit and a desire to continue cheating.
— But these are no longer movers at all.
— Hence the direct conclusions regarding the change of leadership in such large numbers. Just putting things in order.
