A customs post is a customs authority that is part of a single centralized system of the Federal Customs Service of the Russian Federation and ensures the implementation of the tasks and functions of the Federal Customs Service of Russia in the region of operation of the customs post (as defined by Order of the Federal Customs Service of the Russian Federation dated September 4, 2014 N 1701 “On approval of the General Regulations on the Customs Post ").

The legal status, duties and powers of posts are enshrined in the Constitution of the Russian Federation, the Customs Code of the Customs Union, Federal Law No. 311-FZ dated November 27, 2010 “On customs regulation in the Russian Federation”, Order of the Federal Customs Service of the Russian Federation dated September 4, 2014 No. 1701 “On approval General Regulations on the Customs Post”, other federal regulations and international treaties of the Russian Federation.

Customs posts (CP)

- These are territorial executive bodies. They are responsible for their region of operation, which may include:

  • Municipalities
    (settlements, districts, checkpoints). For example: customs post Pogarsky (code 10102080), operates within the Pogarsky municipal formation of the Bryansk region, TP MAPP Nekhoteevka (code 10101120), operates within the multilateral automobile checkpoint (MACP) “Nekhoteevka” of the Belgorod region.
  • Transport infrastructure facilities
    - river or sea port, airport, railway station, etc. For example: customs post Vnukovo-cargo Airport (code 10001020), or TP Seaport of Kaliningrad named after N.S. Khazov (code 10012170) in the Kaliningrad region.
  • Large enterprises
    . Territorial bodies of the Federal Customs Service of the Russian Federation may be located on the territory of some large enterprises, for example: the customs post of the Novolipetsk Metallurgical Plant (code 10109020).

Customs posts report directly to customs or regional customs departments and are the lowest link in the customs system. However, it is at the post level that most of the customs operations for declaring, importing and exporting goods are carried out.

How many customs posts are there in Russia? Today there are 537 divisions in the Russian Federation. 93 of them are under the jurisdiction of customs offices directly subordinate to the Federal Customs Service of the Russian Federation (Vnukovo customs, Domodedovo customs, etc.). Another 3 are directly subordinate to RTU.

Functions of a customs post

The main function of customs posts is customs inspection and customs clearance of goods transported across the border. It may be noted that in practice there is a division between customs posts. The main task of border crossing points is to check the availability of customs documents and verify that they are filled out correctly. They also monitor the passage of goods across the border and from the border to the internal customs post. The main burden of customs operations falls on internal customs clearance points. Such specialization is justified from the point of view of relieving border posts, freeing them from unnecessary formalities, accelerating cargo turnover and increasing the efficiency of customs control.

The tasks of internal posts include:

  • Carrying out inspection and clearance of cargo;
  • Conducting personal customs inspection;
  • Verification of documents and financial and economic activities of enterprises participating in foreign trade activities;
  • Collection of duties, taxes and fees.

The powers, competence, rights and obligations of territorial customs authorities are determined by Order of the Federal Customs Service of the Russian Federation dated September 4, 2014 N 1701.

Customs clearance of parcels

If such a nuisance occurs as a parcel being detained by customs for additional clearance, there is no need to panic. Most often, parcels are delayed for cost assessment and, if you indicated the correct amount in the declaration, the parcel will be allowed to be transferred for delivery after providing confirmation of price information (purchase invoice from the store).

If the parcel was sent by Russian Post, you must wait for a notification of the parcel's arrival at the nearest post office where there is a FCS (Federal Customs Service) post. Next, go to the indicated office with your passport and its photocopy, pay the accrued payments and receive the parcel.

What to take with you:

  • passport and photocopy;
  • TIN of an individual and a copy;
  • the letter you received from the customs service;
  • a printed order form from the online store confirming that you actually made a purchase;
  • an extract from your bank - as proof that it was you who made the order;
  • documents of relatives (passports, copies, marriage certificate, etc.) - to justify a large number of goods or their similarity;
  • cash – to pay for exceeding duty and weight limits;
  • photographs and descriptions of the goods contained in the parcel - if detailed explanations are required.

If you are detained due to suspicion of understating the declared value of goods, it is not difficult to figure it out on your own. It is enough to contact the customs inspector responsible for processing your parcel and provide the necessary supporting documents. These include: a copy of the passport, taxpayer code, invoice for the goods from the online store (a screenshot of the goods indicating the cost on the day of purchase is also useful), a link to the goods in the online store, an extract from a bank account or payment system for the payment transaction for the goods.

If the data cannot be provided, the customs inspector will assess the value of the goods and, if necessary, assess the taxes due. In this case, you need to make a payment using the details specified in the message, provide a copy of the receipt to the inspector and wait for the parcel to be delivered to the specified receiving address (the parcel is transferred from the customs temporary storage area to the delivery service within 3 - 7 days).

If the parcel was sent by express delivery service (DPD, SDEK, UPS, DHL Express), then you must wait for a notification from the Federal Customs Service by email, mail or SMS notifications (depending on the operating mechanism of a particular carrier). All customs clearance procedures are carried out by the broker of the express carrier company; you will only be required to provide the data requested by the customs clearance agent in electronic form. Most often, parcels are delayed due to incomplete data; perhaps you did not provide any required data (for example, TIN) or the cost of the product on the website does not correspond to that indicated in the invoice (this is where a screenshot of the product on the website on the day of purchase comes in handy). In this case, the parcel will be transferred to the delivery service immediately after providing all the missing information.

If a clear excess of the limit is established and, as a result of checking the data by customs, a decision is made to charge a duty, then first you will need to pay all taxes and duties, and then wait for the parcel to be released by customs and transferred to the delivery service

Organizational structure of the customs post

Any customs post consists of departments organized on a territorial basis. For example, as part of the Crimean customs (code 10010000) there is a Krasnoperekopsky customs post (code 10010010). Structurally, it consists of the following departments: Department of customs clearance and customs control (OTO and TC) No. 1 (code 10010014), UTO and TC No. 2 (code 10010011), UTO and TC No. 3 (code 10010012) and UTO and TC No. 4 (code 10010013).

The customs post is headed by a chief who is appointed and dismissed by the head of the Federal Customs Service of Russia. The head of the customs authority bears personal responsibility for the implementation of the powers assigned to the unit headed by him, the implementation of programs, plans and performance indicators of the customs body.

The head of the post, in agreement with the regional customs department, can appoint and dismiss his deputies.

Customs inspectors are appointed and dismissed by order of the customs or by order of the post (for posts that are a legal entity).

The costs of maintaining the post are financed from the federal budget.

The liquidation of posts occurs by decision of the Federal Customs Service of the Russian Federation.
