Why do you need a CASTO qualification certificate?

In accordance with current legislation (Customs Code of the Customs Union, Federal Law of November 27, 2010 N 311-FZ “On customs regulation in the Russian Federation”), each organization providing services in the field of customs (customs representative) is required to have in its staff of at least 2 employees (specialists in customs operations) with qualification certificates.
To pass the qualification exam and receive a certificate of a specialist in customs operations, applicants must meet the following requirements:

  • — mandatory completion of higher education;
  • — mandatory presence of Russian citizenship.

Qualification exams are conducted on the basis of regional customs departments (RTU). Thus, at the North-West Customs Administration, the examination commission meets once a month (with a break in the summer).

As a rule, candidates undergo training at accredited institutions before registering for the exam. Preparation includes theoretical and practical parts. The qualification exam program was approved by Order of the Federal Customs Service of Russia No. 2605 dated December 21, 2015. “On approval of the qualification exam program for specialists in customs operations”, the appendix to which provides a list of exam questions and topics studied by applicants for the CASTO certificate.

Every two years, starting from the year following the year of receiving the qualification certificate, a customs operations specialist is required to undergo training under an additional professional program.

An employee who has a CASTO qualification certificate is certainly valuable not only for a customs representative company, but also for other organizations that independently declare goods without contacting a customs broker (representative), since the presence of a CASTO presupposes a serious level of theoretical knowledge and practical skills in field of customs affairs.

Customs Operations Specialist (Declarant)

Basic program

The program “Customs Operations Specialist, Declarant” (with receipt of a FCS qualification certificate) is a course that provides full training for a customs specialist in accordance with Order of the Federal Customs Service of Russia dated December 21, 2015 No. 2605 “On approval of the qualification exam program for customs specialists operations"

The course offers fully face-to-face training, but with some self-study required. Lectures and practical classes are conducted by highly qualified teachers in an accessible form, are easily understood by students, but also require additional work on the material in their free time.

How to obtain a FCS qualification certificate?

To receive a qualification certificate, the applicant must successfully pass the exam. To obtain admission to the exam, the applicant, no later than 30 calendar days before the announced start date of the exam, submits to the regional customs department at his place of residence (at his place of stay):

  • statement;
  • a copy of a passport or other identity document;
  • a document on higher education received in Russian educational institutions of higher education, or a document from a foreign state on higher education and a certificate of recognition in the Russian Federation of education and (or) qualifications obtained in a foreign state (hereinafter referred to as foreign education and (or) foreign qualifications) , in the form of originals or copies certified in the prescribed manner.

    If there was a change of surname after receiving the certificate, documents confirming this fact are also provided.

The procedure for passing the qualification exam, issuing and revoking qualification certificates is given in the Administrative Regulations of the Federal Customs Service for the provision of public services for issuing and revoking qualification certificates for specialists in customs operations.

Training of specialists in customs operations.
A specialist in customs operations can be a citizen of the Russian Federation who has a higher education, has passed a qualification exam and has confirmed that his knowledge complies with the qualification exam program. This training program is intended for specialists with completed higher education who:

  1. it is necessary to obtain a qualification certificate for a Customs Operations Specialist (CSTO) ;
  2. or it is necessary to renew the qualification certificate of a professional technical professional (the previous one was received 2 years ago).

What does training give?

The course program was prepared in accordance with Order of the Federal Customs Service of Russia No. 2430 dated December 15, 2010 “On approval of the qualification exam program for specialists in customs operations.” The program includes lectures on basic issues of customs legislation and practical classes on filling out customs documents.

Upon completion of training, a Certificate of completion of the course/advanced training is issued. Based on the results of passing the qualification exam* of the examination commission of the customs department (at the specialist’s place of registration), a qualification certificate is issued/renewed, valid for the next two years.

Responsibilities and rights of the customs declarant?

The customs declarant has the right:

  • inspect and measure the cargo subject to declaration (the customs declarant can do all this even before submitting the customs declaration);
  • view the results of samples and tests of goods held at customs;
  • take samples and tests of goods imported into the territory of the Russian Federation and subject to declaration (this is allowed to be done only with the permission of customs officers);
  • submit the documents necessary for declaring products in electronic or written format;

The customs declarant is obliged:

  • submitting a declaration to customs, which must be prepared in accordance with all government regulations, as well as providing all necessary information and documents regarding the cargo;
  • in the event that the customs inspector demands to present the cargo subject to declaration, do this, and also do not refuse to show the transport in which the declared products were transported;
  • provide settlement of customs duties or pay them yourself in accordance with the provisions of the Labor Code of the Russian Federation.

If a company produces its own goods, then it is allowed to carry out declarations independently, but to do this, its staff must include a declarant who has the necessary license to engage in this activity.

Declarant

In accordance with Part 3 of Art. 55 of the Constitution of the Russian Federation, paragraph 1 of Art. 22, paragraph 3, art. 23, paragraph 1, art. 49 of the Civil Code of the Russian Federation and Art. 3 of the Labor Code of the Russian Federation, restrictions on the legal capacity of persons, including those related to the implementation of certain types of activities, can only be established by law.

The legal status of the declarant is determined by Art. 126 of the Customs Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation). Russian persons acting on their own behalf can act in this capacity (clause 15, clause 1, article 11 of the Labor Code of the Russian Federation). In addition, declarants can be any other persons who have the right, in accordance with the norms of civil legislation, to dispose of goods within the customs territory of the Russian Federation (clause 1 of Article 126 of the Labor Code of the Russian Federation). There are also a number of exceptions that establish the possibility for foreign persons to act as a declarant.

The customs legislation of the Russian Federation does not contain such a requirement as the declarant having a qualification certificate of a customs clearance specialist.

Procedure for submitting documents

No later than 3 working days before the date of the qualification exam, the applicant must provide the following sets of documents to the Certification Commission for taking qualification exams for financial market specialists:

for admission to the BASIC qualifying exam:

  • application form;
  • photocopy of the document confirming payment (sample receipt for payment);
  • photocopy of passport (pages 2-5);
  • contract for paid services (in two copies);

for admission to the specialized qualification exam (SERIES):

  • application form;
  • photocopy of the document confirming payment (sample receipt for payment);
  • photocopy of passport (pages 2-5);
  • a document confirming passing the basic exam (qualification certificate, extract from the protocol of the certification commission of another accredited organization);
  • contract for paid services (in two copies);

The procedure for issuing qualification certificates

Within 15 working days from the date of the qualification exam, a citizen who successfully passes the specialized exam is issued a certificate issued in the type and form approved by the Federal Financial Markets Service of Russia.

The qualification certificate of a financial market specialist is unlimited .

When receiving a qualification certificate, the applicant is required to present an identification document ( passport ) or a document replacing it. A mandatory condition for issuing a certificate to the applicant's representative is the presence of a power of attorney certified by a notary.
