Rules for customs clearance of a car in the DPR

If you plan to bring a car to the DPR from Georgia, Europe or Russia, then you will have to clear it through customs or bring it in for a non-temporary import.

Upon arrival at the customs point of entry into the territory of the DPR/LPR, you must have the following documents in your hands:

  • registration certificate for the vehicle (most often in a foreign language);
  • vehicle purchase and sale agreement;
  • transit license plates;
  • photocopy of the car owner's passport.

At the customs point you will receive:

  • DPR/LPR passenger customs declaration (hereinafter referred to as PCD) in one copy (a sample PCD can be viewed here

  • obligation to deliver the vehicle to the internal customs point (in two copies);
  • vehicle inspection report (1 piece);

With a complete set of documents, you are sent to the DPR/LPR MREO for an initial inspection of the car (theft check). At the MREO you need to go to the “Acceptance of documents” window, hand in the documents, having first had them translated to a translation agency. After checking the vehicle at the MREO, you go to the customs broker.

A DPR/LPR customs broker will help you draw up the necessary package of documents, and will also calculate the cost of excise duty for customs clearance of a car in the DPR, take you to the customs terminal and carry out customs clearance. After customs clearance of the vehicle, you are sent to a certified service station to undergo technical inspection. There you will receive a certificate about the technical condition of the car. This certificate is required to register the car. On average, the cost of service station services is 1200-1300 rubles.

With the remaining package of documents, you go to the MREO at your place of registration to register the car. At MREO you undergo another examination, costing 4,000 rubles, pay transport tax (calculated based on the year of manufacture of the car and engine size), and a fee for obtaining license plates (~435 rubles), for obtaining a technical passport (~435 rubles).

After receiving the license plates and registration certificate, the car is completely cleared through customs.

Rules for customs clearance of trucks in the DPR

There are no excise taxes on customs clearance of trucks. Instead, an expert assessment (MREO specialist) of the cost of the car is used.

How much time is given for customs clearance in the DPR?

5 working days. At the border they will write to you the deadline for clearance.

Temporary registration certificate for 3 months in the DPR

After customs clearance of the car, you are issued a temporary registration certificate and license plates for 3 months. This is done so that you do not have the opportunity to sell the car within 3 months after customs clearance.

FEATURES OF EXPORT TO LPR

The main difficulty in processing international transactions with the LPR is the lack of full communication between Russia and the Lugansk People's Republic for interbank payments. Russian companies can receive funds in payment for goods from Lugansk partners only in one Russian bank - TsMRBank (Bank "Center for International Settlements"). In some cases, it is easier to use the services of conducting an export transaction through an intermediary company that has an account with this bank.

Which cars from Russia can be cleared through customs?

Taking into account the laws on customs clearance of cars in Ukraine, it becomes clear that the choice of cars from Russia is significantly narrowed. Ukrainian citizens can purchase and clear customs in their country only those cars that were manufactured in other states, but were later registered in the Russian Federation.

Imported cars imported into Ukraine must meet two more conditions. Firstly, their environmental class should not be lower than the Euro-2 standard. And, secondly, the car must be registered to an individual for personal use.

Having found a suitable car in Russia and made sure that it was produced outside the Russian Federation, you need to enter its license plate number or VIN and, based on the data received, decide whether to look at the car or not.

EXPORT CLEARANCE TO LPR

For smooth customs clearance of exports to the Lugansk People's Republic, the following documents will be required:

  • International sales contract. We can check an already concluded agreement or draw up a new one that complies with Russian foreign trade legislation. The form of the contract, which we have developed and are constantly improving, has been agreed upon with Russian customs and the Ministry of Trade of the LPR.
  • Invoice, packing list. We will advise you in which case an invoice is issued, and in which case an invoice is sufficient, and what are the specifics of filling out these documents.
  • Construction and installation work (consignment note). Since the border with the LPR passes by land, it is necessary to issue an international consignment note. Export to the LPR is carried out through automobile checkpoints of the Novoshakhtinsk checkpoint of the Rostov customs and the Donetsk checkpoint of the Millerovo customs, each of which has its own requirements for transport documents, which we know about.
  • Export licenses, approvals, permits. The legislation on export control in Russia is very complex, so it is necessary to clarify the need to provide permits for export to the LPR on a case-by-case basis. If registration is still necessary, we will do everything possible to complete it as quickly as possible, avoiding downtime.

When customs clearance of exports to the LPR, customs officials may request other documents and information; their preparation will need to be carried out as quickly as possible in order to avoid delays at customs. Registering an imported car

After completing customs clearance, the owner will need to visit a certified service station, where a technical inspection will be carried out. You will have to pay up to 1,500 rubles to undergo the inspection. At the end, they will issue a certificate about the technical condition of the car, which is needed for registration.

Car registration takes place at the MREO office at the place of registration. There you will need to undergo the latest paid examination (up to 5,000 rubles), as well as pay:

  1. transport tax (calculated based on the year of manufacture of the car and engine size);
  2. fee for obtaining a number (up to 500 rubles);
  3. registration fee (about 500 rubles).

As soon as the owner receives license plates and a technical passport, his car is considered finally cleared through customs.

So, customs clearance takes only a few days, but a citizen of the DPR or LPR will have to pay several fees. Funds are charged first for checking the condition of the car, then for registering it.

What cars cannot be imported from Russia to Ukraine

Preferential customs clearance of cars in Ukraine in 2021 applies to cars with European license plates. For example, customs clearance of cars from Poland in Ukraine will be more profitable for Ukrainians than cars imported from outside the European Union. Previously, this also applied to cars manufactured on the territory of the Russian Federation. But with the adoption of Resolution of the Cabinet of Ministers No. 1147 of December 30, 2015 and Resolution of the Verkhovna Rada of Ukraine of January 27, 2015 No. 129-VIII, customs clearance of such vehicles in Ukraine is prohibited. This applies to both new and used vehicles.

Customs clearance of cars in Ukraine under the new laws is impossible not only for cars from the Russian automobile industry. We are also talking about cars of foreign brands that are assembled in Russia. In particular, the ban applies to Russian-assembled cars of such brands as BMW, Mercedes-Benz, Renault, Toyota, etc. Therefore, in Ukraine, customs clearance of cars from Germany and other European countries is a real alternative when purchasing an imported vehicle.

Since customs clearance of Russian cars is prohibited in Ukraine, before buying a car from Russia it is worth checking the country of its production. This can be done using the vehicle's VIN. If it begins with the letter “X” or “Z”, then the vehicle was manufactured in the Russian Federation. To avoid problems, it is better to refrain from purchasing such a car.

The LPR Customs Committee told how to transport purchases from Russia across the border

Shopping trips to Russia do not lose their relevance. Almost every day there is a fairly large number of people who want to travel to a neighboring country and then return home with new acquisitions. But how to do it correctly so as not to become a violator? What are the requirements of customs officers when moving goods across the border? What happens if you overstay your temporary import? First Deputy of the State Customs Committee Dmitry Sulitsky spoke about this in an interview with the Orient Express newspaper.

– Let’s start, according to tradition, with the most pressing issue – the movement of goods for personal needs across the border. For example, if a person purchased household appliances (TV, refrigerator, furniture) or auto parts, tires for cars in Russia, what should be the procedure for transportation?

– When importing these goods at the LPR checkpoint across the border with Russia, the citizen must declare the import of such goods and provide a document confirming the value of the goods (receipt, invoice, waybill, etc.), and other shipping documents if necessary. If the cost of goods exceeds the equivalent of 200 euros and/or the total weight of which exceeds 50 kg, then such goods are subject to mandatory written declaration in the manner prescribed for citizens. Such declaration is carried out at the checkpoint at the customs border of the LPR directly upon import of these goods. To do this, it is necessary to fill out a passenger customs declaration and pay import customs duties in accordance with the rates established by the Law of the LPR “On the rates of import customs duties and the procedure for their collection.” For the goods we are talking about now, the customs duty is 2% of the customs value of the goods. Plus a customs fee for customs clearance of 0.2% of the customs value of the goods, but not less than 20 euros and not more than 1000 euros.

– And if you need to transport light, inexpensive, but large-sized material, for example, sheets of foam from the Russian Federation. I would like to know how to do this correctly so that there are no problems?

– The procedure is no different from importing household appliances. If the cost of the goods does not exceed the equivalent of 200 euros and the weight does not exceed 50 kg, then it is imported duty free. In case of exceeding the permissible norms, customs clearance is carried out, customs duties and fees are paid. And, of course, you must have with you documents confirming the purchase of the goods and its cost.

– How many purchases can I bring from the DutyFree store, for example, alcohol and tobacco products?

– It doesn’t matter where the goods were purchased. A citizen can carry 1 liter of vodka, 2 liters of wine, 5 liters of beer without any obstacles. As for tobacco products, the permissible volume is 200 cigarettes or 200 grams of these products, imported in personal luggage by citizens.

– Have there been any changes in customs legislation for citizens? If yes, which ones exactly?

– Of course, there are changes. There are quite a lot of them, but basically they all relate to business entities. Citizens now have benefits when importing inherited vehicles into the LPR.

– How to import an inherited car now? What exactly will these benefits be?

– When importing a car received by inheritance, a citizen must comply with legal procedures: present a document confirming the fact of inheritance of this vehicle, deregister the car in the country where it was registered, and also fill out all the necessary documents for the vehicle for import. If everything is in order with the documents, then the car is registered without paying customs duty. Please note that the customs fee for customs clearance is not canceled. Its amount is 0.2% of the cost, but not less than 20 euros and not more than 1000 euros.

– Since we’ve touched on the automotive topic, please tell us about the rules that must be followed when importing a car under the “temporary import” regime. For how long can I import a car?

– Temporary import of vehicles is permitted for one’s own needs for a period of up to one year. At the same time, an individual who temporarily imports a car into the territory of the LPR, in the passenger customs declaration, gives written obligations about the return export of the car with an exact indication of the date.

It is important to remember that temporarily imported vehicles cannot be dismantled for spare parts or transferred into the possession or use of other persons. In addition, such cars cannot be used for business purposes, including being leased or transferred by proxy for the use of other persons. In the “temporary import” customs regime, it is important to fulfill the obligation to re-export within the period specified in the passenger customs declaration.

– What if this is impossible to do for some objective reasons?

– If it is impossible to re-export the vehicle within the specified period due to force majeure circumstances (force majeure), for example, such as illness of a citizen or breakdown of the car, it is necessary to contact the State Customs Committee of the LPR with a written application before the end of the obligation to re-export the temporarily imported vehicle. The application must be accompanied by documents confirming one or another valid reason why the car cannot be removed on time.

– What threatens a person who violates the temporary import period without a good reason?

– For violation of the deadlines for the return export of a car from the territory of the LPR, administrative liability is provided in accordance with Article 481 of the Customs Code. The sanction of this article is the imposition of an administrative fine from one thousand 700 rubles to 34 thousand rubles, depending on the excess of the established period of temporary import.

– We’ve sorted out the transport issue. Tell me, is it possible to cross the border with a pet (dog)? What is needed for this?

– You can cross the border if you have the necessary documents. The list of documents and rules for moving animals can be found on the website of the State Veterinary Medicine Service of the LPR. For our part, we can say that pets that are imported into the customs territory of the LPR are subject to mandatory written declaration and the application of control measures to them established by the legislation of our republic.

– Tell me, what if a person considers the actions of customs officers unlawful? Where should he go?
