HomeInformation Determine the HS code

Determining the HS code by the name of the product is quite a difficult task for a non-specialist who is encountering this for the first time. For our specialists, this is a simple task that will help you relieve yourself of responsibility in correctly determining the HS code by product name. You will only need a description of the product (its technical or composition).

The commodity nomenclature of foreign economic activity (TN FEA) is a classifier of goods that is used in the territory of the Eurasian Economic Union when carrying out customs operations. The purpose of the classifier is that a specific category of goods is assigned a unique code and the amount of customs duties for export or import is determined. The use of a classifier simplifies the system for identifying goods, assigning duties and information processing of customs documents. It consists of a ten-digit code of the Commodity Nomenclature of Foreign Economic Activity and includes 97 groups of goods, including a commodity item, subitem and sub-item when defining a product.

Responsibility for determining HS codes lies with the declarant, that is, with the person who exports or imports the product. The declarant can find the HS code on his own, using open resources, or seek help from professionals who know the features of the classification and can correctly determine the HS code of the product.

There are cases when customs authorities do not accept the code chosen by the declarant and classify the goods at their own discretion. Discrepancies in the interpretation of the classifier arise due to the lack of a universal comprehensive reference book that could contain all the variety of products existing in the world.

What is a HS code?

The Classifier of HS codes has an extensive catalog system. It is divided into 21 sections, 97 groups, and has commodity items, subitems and sub-items.

TN VED code - consists of ten characters XX XX XX XX XX. Each of these marks corresponds to a specific product group. The table of HS codes for each product contains the full name and a ten-character code. The first six digits of the code are the same in most countries for the same product groups. This can be used when importing if you find out the HS code from a foreign supplier and use the first six characters from it.

  • The first two signs are the product group (66 - Umbrellas, sun umbrellas).
  • The first four characters are the trade item (6601 - Umbrellas, sun umbrellas, including cane umbrellas, garden umbrellas and similar umbrellas).
  • The first six characters are the subposition (660199 - Other).
  • The first eight characters are subheading (66019920 - covered with woven textile materials).
  • Ten characters, full HS code (6601992000).

Comparison of HS codes and OKPD 2

All-Russian classifier of products by type of economic activity (OKPD 2) is a standard adopted on the territory of the Russian Federation for control and information processing of data on products and services of all sectors of the economy. The OKPD 2 classifier of goods and services is compiled taking into account European standards. The classifier code consists of 2 – 9 digits that indicate classes, subclasses, groups of goods or services, subgroups, types of products, categories and subcategories.

When carrying out foreign trade operations, in particular when certifying products, both the HS code and the OKPD 2 code are simultaneously required. A uniform code compliance system has not yet been developed, but there are keys that tell you how to determine OKPD 2 using the HS code. Published on the website of the Ministry of Economic Development tables that allow you to compare these two codes.

What are OKVED codes

Keep records of exports and imports using the simplified tax system in the Kontur.Accounting web service.
Currency accounting and work instructions, taxes, automatic payroll calculation and sending reports in one service Get free access for 14 days The All-Russian Classifier of Types of Economic Activities (OKVED) is a collection of codes assigned to the types of activities of companies. To select a code, the form of ownership or taxation system is not important. The main thing is what the company does.

For example, a company that recruits employees based on other people's requests will choose code 74.50 - labor recruitment and selection. In 2021, the OKVED2 classifier is in effect - OK 029-2014.

When registering a new company, the tax office enters information about its activities in the Unified State Register of Legal Entities or Unified State Register of Individual Entrepreneurs. When registering an individual entrepreneur, they are indicated only in the application, but when creating an LLC, they must be reflected in the organization’s charter.

OKVED codes are needed to register a business and to set an insurance rate in the Social Insurance Fund. Some banks also request them to open a current account. They are displayed in the Unified State Register of Legal Entities and the Unified State Register of Individual Entrepreneurs. The tax office ensures that the OKVED code corresponds to the transactions carried out by the business.

How many OKVED codes can a company have?

You can choose any number of codes, starting with one, there are no restrictions by law. We do not recommend specifying more than 20 codes. As a rule, companies choose 5-6 codes. The first code indicated is the code of the main activity. It is important that each selected code must contain at least four characters.

OKVED for foreign economic activity

Foreign economic activity is a sphere of activity of enterprises, and not a special type of economic activity. Foreign economic activity is associated with import, export, foreign trade, foreign investment, etc. The classifier does not have a special code for foreign economic activity, because the code does not depend on where the goods originated and where they will be sold.

If you were engaged in wholesale trade and decided to go international, there is no need to change the type of activity and add new codes to the charter. This will be required, say, if you were breeding fish in fresh water bodies and selling them on the market, indicating OKVED - 03.22 and 47.81, and then decided to start selling fish wholesale abroad. In this case, your type of activity changes (retail trade turns into wholesale), so you will have to make changes to the charter.

The charter of your organization should list all types of activities that you want to engage in with foreign partners. In addition, the charter must make a note that you have the right to conduct economic activities that do not contradict the laws of the Russian Federation. If you are unsure which code to select, contact your tax office for clarification. You will use the official response in case of disputes with regulatory agencies.

Attention! OKVED contains code 84.21 “International activities” - this code is not applicable for foreign economic activity. It has the right to be indicated by government bodies that deal with military, medical and humanitarian assistance, as well as the management of foreign trade, consular missions and cultural services.

  • On the title page, indicate the reason for filing the application - “1” if, along with changing the codes in the Unified State Register of Legal Entities, you will be changing the charter, and “2” if only the information in the Unified State Register of Legal Entities is changing.
  • On page 1 of sheet K, indicate only those codes that have not previously been entered into the Unified State Register of Legal Entities. Organizations have the right to engage in activities that were not indicated in the Unified State Register of Legal Entities upon registration. But this must be reported to the Federal Tax Service. From the date of commencement of a new type of activity, the period for submitting an application begins to count - seven working days. Otherwise, you may receive a fine of 5,000 rubles under Art. 14.25 Code of Administrative Offenses of the Russian Federation or lose the right to tax preferences.

What to do if it was not possible to correctly determine the HS code by name

When the declarant selects the HS code, he must strictly adhere to the principle of unambiguously assigning goods to a specific group. If you can choose the correct HS code, customs clearance of goods and the calculation of duties occurs without hindrance.

Administrative liability is provided for the deliberate statement of false information when declaring goods, if this information led to an understatement or cancellation of customs duties, taxes or the receipt of other benefits.

In case of problems with the classification of goods, the declarant has the right to contact organizations that have experience in this area and will help to correctly determine the HS code.

What is the HS code for?

The HS code (TN VED) determines which documents to issue for the product - the CU TR certificate of conformity or the CU TR declaration of conformity or the SGR

You will be able to find answers to the question of what kind of certificate or declaration of conformity needs to be issued for products according to the HS code. Therefore, knowing the HS code (TN VED) or the name of the product you want to know about, you need to issue a GOST R certificate for it, technical regulations of the Russian Federation or technical regulations of the Customs Union, or a declaration for these profiles.

If you do not find your products in this list, then your products are not subject to mandatory certification and it is quite enough to issue a GOST R Voluntary Certificate or an Exemption Letter for Customs for your clients.

Based on the above, it is necessary to take into account that this information is constantly updated in connection with the introduction of new TR CU and in any case, you better check with our experts about the relevance of the data below.
